For the second time, the U.S. Supreme Court has vacated a lower court decision against a Christian couple in Oregon who were punished for not making a cake for a same-sex wedding.
In an orders list release Friday, the nation's highest court vacated the decision against Aaron and Melissa Klein in their ongoing litigation with the Oregon Bureau of Labor & Industries.
The court sent the case back to the Court of Appeals of Oregon for reconsideration in light of its same-day ruling in 303 Createive LLC v. Elenis. In that case, the Supreme Court ruled 6-3 that Colorado cannot force Lorie Smith, a Christian graphic artist, to design websites that celebrate same-sex marriage, which she was opposed to doing on religious grounds, despite the state's protective anti-discrimination law.
“It’s a win when the Supreme Court vacates a bad lower court decision like it did for Aaron and Melissa today, but the case is not over," said Kelly Shackelford, president of the First Liberty Institute, which is representing the Kleins, in a news release.

Decades ago, my future wife and I drove into Las Vegas, and there all these places on the road promising to find us a hotel for the night. So we finally stopped at one. The first thing they asked is whether we were married. We said “not yet”, they said “sorry, then, we cannot help you”.
Oh well, we found a motel ourselves. No lawsuit necessary.
And it makes me wonder, just HOW HARD did this plaintiff try to find another Website Designer, one that does work for gays? If he brought a FEDERAL LAWSUIT, it must be far more difficult than I imagine. If not, then why did he even have ‘standing’? After all, I suspect that he could have just picked the next Website Designer in the Yellow Pages (code word for us older folk) and likely had a designer - sounds like virtually no harm done to him.
The Alphabet Mafia intentionally target Christian business and proceed to set them up. They inquire about their service and if they get the answer they REALLY want, which is, “Sorry, we can’t accommodate your request as it’s against our Christian beliefs.”, then they’ve got the potential lawsuit they were after. It isn’t about finding someone who will serve them, it’s about finding someone who WON’T.
These cases are lawfare targeting of Christians and their businesses by leftist activist lawyers.

I was pleasantly surprised with the decisive rulings from the Supreme Court this past week. Justice Roberts seems to have finally learned that you cannot appease the left.

In a just world when the kwheers initially filed their lawsuit a reasonable question for the judge to ask would some form of “Did the plaintiffs have reasonably available alternative providers of the service they required?”
In this case “Are there other web designers within a few miles of the defendant’s place of business?”
If the answer is ‘Yes’, ... case dismissed.

The fact that this had to go all the way to the supreme court is more than disconcerting. Whatever happened to common courtesy and respect for personal convictions?

Bakeries can avoid this by putting out a catalogue of their options and not deviating from those options.

You are a liar. The poor choice of words to describe Colorado’s (he was writing about the Smith case) anti-discrimination laws which includes alphabet mafia does not justify this.
