Chief Justice Roberts says leaked abortion opinion is authentic but not final, opens investigation

Chief Justice John G. Roberts Jr. said Tuesday that the leaked draft opinion proposing to overturn Roe v. Wade is authentic but not final, and that he is opening an investigation into how it became public.

“To the extent this betrayal of the confidences of the Court was intended to undermine the integrity of our operations, it will not succeed,” Roberts said. “The work of the Court will not be affected in any way.”

While Roberts’s statement said the draft provided to Politico was genuine, “it does not represent a decision by the Court or the final position of any member on the issues in the case.”

Supreme Court is ready to strike down Roe v. Wade, leaked draft opinion shows The Politico report said that five justices had decided to uphold a Mississippi law that would ban abortions after 15 weeks of pregnancy, and overturn the decision that established a constitutional right to abortion nearly 50 years ago.

Roberts’s news release was another extraordinary deviation from the court’s normal procedures, which generally entails paying no attention to outside influences. It was a sign that Roe v. Wade is too important, and the breach of Supreme Court operations too monumental, to ignore.

Majority of Americans say Supreme Court should uphold Roe, new Post-ABC poll finds Republican politicians in particular have called for an investigation into the leak, which some have seen as an attempt to put pressure on justices who may be inclined to strike down Roe instead to modify their decisions.

That shows us how weak and frightened the Dem Machine is right now.

They have to go to great extremes to get out the vote and increase their funding.

In anticipation of their slaughter in November, they must resort to extraordinary means to motivate their people. Especially the women, who are increasingly complacent since Biden became President.

Now they have a rallying cry:

Get off your fat butt , babe, and go gin up the vote.

And, while you’re up, make me a sammich and get me a beer. 😜

Roberts has done more damage with his actions today. He is rewarding the leakers by: (1) confirming the authenticity of the draft; (2) saying that the court will not deviate from the current schedule, thereby allowing the left up to two months to threaten/pressure the justices in the majority.

He had a moral obligation to: (1) remain silent, (2) allow the majority to choose the timing of the release of the decision now. Ideally, if the majority is content with the draft now, the dissenters who did this should have no more than 24 hours to finalize their statements, before the is released.

Roberts has rewarded the people who did this and made life an absolute hell for the 5 justices in the majority for the next two months.

Investigate, investigate, that’s all Washington does. And has any laws been broken.? Throw a few detector experts at the Supreme employees, including Justices, and in a few days and the perp would be known.

Considering the document was labelled “first draft”, we knew the opinion wasn’t final. I’m sure Roberts has worked hard to water down the opinion. He will want the largest majority he can get, which is probably 6-3, so he’s likely the lone holdout. Based on his questioning during arguments, he will push to write the opinion around “viability” to garner his vote. Alito and Thomas are solid, and I think Gorsuch is unlikely to be swayed to compromise. Kavanaugh and Barrett, not sure.

If they want to gain momentum, they have to start now to move now. Its not like an October surprise to catch the undecided vote, they want a show of force and that’s why they are rattling the cage and getting the kind hopping mad.

My feeling is that Roberts doesn’t really want to know who did this because it would require a very public punishment that would hurt at least one of the justices. The investigation will not be thorough, and it will not be quick.

The Justices may not have actually met to vote, but they seem to have deliberated the case. I think there’s a sense of where everybody is at and therefore, which way the vote is going to go if not the actual score.

The truth of the matter is that Roe v. Wade was entering the kill-zone for a reversal back when ‘W’ was in the White House. It’s basically taken from then to now for the court to tilt conservative and for them to find the right state law on which to rule. It was never ‘if’ Roe would be overruled, but ‘when’.

This bit of theater is a last desperate gamble to wake up Dem voters for the mid-terms. The first is the continued flirtation with forgiving student loan debt. I don’t think it’s going to work.

My understanding is the justices take an initial vote right after hearing most cases. Then justice(s) are assigned to write the majority and minority opinions. The majority opinions are usually assigned in a round robin fashion, based on a 2 week schedule.

My understanding is initial was a 5-3 to completely over turn Roe. Roberts is wanting to limit abortions after 15 weeks, but not completely over turn Roe. Court watchers expect him to ultimately join the majority to have influences on the final wording... most likely to water it down.

Announce that the leaker is a national hero for risking their career to advance the cause of women’s rights—and therefore would be honored, not punished.

The leftist leaker would believe it and would be thrilled to step forward to get their trophy!

If Sotomayor's lackeys can leak, then conservative functionaries can devise a fresh "bait car" draft opinion, use a draft opinion of the 5th justice that this leak was supposed to influence -- how apropos! Make it a concurring opinion.

Use interceptors/geofences/sniffers/keylogs/macros ... ALL OF IT. LAY DOWN THE GODDAMN HAMMER.

Interesting. I thought that the Chief Justice usually wrote the opinions when he was in the majority. I thought it was significant that Alito wrote the majority opinion... guess not?
