A dry new year's weekend for Texas: State law keeps liquor stores closed

HOUSTON — Thousands of people moved to Texas again this year, and if you’re one of them, you may not be aware of some of the unusual laws we have, especially those that deal with buying alcohol.

All liquor stores are closed in Texas on New Year’s Day and lots of folks had no idea.

“ The state law reads that every liquor store in the state of Texas has to be closed on Sundays, Christmas Day, and New Year’s Day."

The law is among what are known as the state’s “blue laws” regulating when hard alcohol can be sold.

New Year’s Day was added to the list in 1979.

This is Texas. Now, a 41-year law stirs up controversy for out-of-staters? Sorry, go back if you don’t like it.

Are you that kind of libertarian?

And do you realize that drug laws don’t actually prohibit what you put into your body, but the possession of the substance?

Not as bad as it use to be. I can remember a time where you could buy a steak on a sunday but you couldn’t buy a frying pan to cook it in .

Yeah, I worked grocery retail during the era of full-blown blue laws. Some retailers just covered up merchandise sections prohibited for sale on Sunday. It was weird, but not “bad.” It was the projection of a Christian moral within society at that time. Sundays were seen as more sacred. I long for those times. Look at what we’ve lost since those regulations were all but obliterated.

There are ‘possession by consumption’ laws. How would you like to be taken to the police station for a urinalysis, based on possession of marijuana paraphernalia?

Where is that written? The law doesn't prevent you from drinking it, just buying it. You can buy it the day or week or month before.

I don't want government bureaucrats telling me what I am allowed to ingest or what I must ingest. A free man makes his own decisions. Remember when alcohol was prohibited in this country?

Substitute your scary list with beef, pork and chicken. What if the government banned meat? If you allow government to ban one item, then any item, even ones you like, could be banned.

If someone wants to take heroin in the privacy of their own home, I don't care. It's their home. It's their body. But if they hurt someone else in doing so, then I care. And I don't want to pay for their medical treatment.

If that makes me a libertarian...

I'm making a more general point about the principle of government controlling or banning items. See my previous post.

No. The government should enforce the rights contained in the Constitution. Any laws should be made based upon this. And that's all. I don't want them telling I must live or I must die. Either we are free people or we are slaves to varying degrees. There is no middle ground.

As far as the "parade", I don't know what that means.

I wish Texas would restrict booze outright. Yes, I’m a states rights kind of guy. It would get rid of a lot of trash.

You’re obviously a leftertarian purist. There is nothing constitutional about that.

So, I’ll predict that you’re all for open pornography of the most extreme kind in public view. You’re for gay “marriage.” You’re for no speed limits on public roads. You’re for drunk driving. Any “restriction” in your book is inherently evil.

Does the impossibility of a goal make it any less a worthy goal?

I’m all for state-level prohibition, of activities which are proven to be a murderous cancer on society. The majority of fatality traffic accidents involving innocent people, including the smallest children, are driven by alcohol consumption. It is a destroyer of families, individuals, lives, productivity and everything good.

I will never back off of my condemnation of it.

You predict wrongly. People should not be allowed to perform acts which hurt other people. Blatant porn in public, speed limits, drunk driving. These actions can hurt others. Not allowed in my freedom utopia. Gay marriage, which I personally find disgusting, I will have to think about.

In Massachusetts you cannot buy a beer until 8 O’Clock in the morning.

So if you work nights, and get home or to the local store at 07:59 you have to wait.

These are very stupid regulations.

Indiana had similar laws growing up in the ‘70’s. I got caught with a 12 pack of beer driving thru a dry county in Alabama once going home for college break, hahaha. The cop saw me buy the beer at a convenience store in a wet area, as soon as I crossed into his jurisdiction he nailed me. Took my beer and let me go. Must have been the officers brand.

Times were different then.
