Biden Administration Urges Supreme Court To Let Cops Enter Homes And Seize Guns Without A Warrant

The U.S. Supreme Court on Wednesday will hear oral argument in Caniglia v. Strom, a case that could have sweeping consequences for policing, due process, and mental health, with the Biden Administration and attorneys general from nine states urging the High Court to uphold warrantless gun confiscation. But what would ultimately become a major Fourth Amendment case began with an elderly couple’s spat over a coffee mug.
(snip)
But in its first amicus brief before the High Court, the Biden Administration glossed over these concerns and called on the justices to uphold the First Circuit’s ruling. Noting that “the ultimate touchstone of the Fourth Amendment is ‘reasonableness,’” the Justice Department argued that warrants should not be “presumptively required when a government official’s action is objectively grounded in a non-investigatory public interest, such as health or safety.”

That argument could be anything. For example: "Biden's latest executive order banning the possession of arms by private citizens is in the interest of safety, therefore public interest allows to the search and seizure and no knock entry into the home of John Smith. It also shields the police from any legal liability from the family of the now dead John Smith who was killed defending his home"
That's what we're looking at here.

I bet the court is OK with this.

It is now reasonable in the interest of public safety to ban gatherings, and to ban worship, both specifically enumerated rights in the Constitution.

A good rule to follow is ask if a DemocRAT administration believes it.
If “yes”, we KNOW that it’s false.

I disagree.
The Court will shoot this down.
To allow this would result in bloodshed on a frightening scale and they know it. Homes all over America would become mini versions of WACO Texas.
To: traderrob6
Agreed. All the good defense attorney should have to say is, “I agree with the prosecution, anybody should be allowed to enter a home to search and seize drugs, illicit sexual items, and stuff like that.”
I bet the liberals would come unhinged.

Of course they want to do this. Of course they will try it. This is their goal! Taking guns from NON-VIOLENT people and leaving them in the hands of violent criminals.
