Larry Schweikart:

1) Just finished a discussion with a pro-Trump congressional source on procedures. Very high.

2) On Jan. 6, all that is needed is 1 senator (Hawley) and 1 Congressman (Brooks) to bring an objection to an elector slate (almost certainly AZ, since that will be the first contested.

3) The rules are made by the previous congress; the laws already in place bind the procedures.

4) Pence has no authority on his own to accept or reject any slate. According to source, he will turn to the Parliamentarian for a ruling on how to proceed.

The only question in my mind is how much debate is allowed when the houses withdraw to consider objections. 3 USC 17’s provision that “each Senator and Representative may speak to such objection or question five minutes” rather clearly denotes a maximum, not a minimum, given the two hour total time limit and the phrase “limit of debate” in the heading.

There will be a lot of pressure to keep debate at a minimum or shut it down entirely. McConnell expressly does not want Republican Senators to have to go on the record one way or the other. However, I’m not familiar enough with House and Senate rules or the extent to which they apply here to guess how that will play out.

No debate is allowed at all in the joint session, as Biden repeatedly had to remind members of his own party in 2017, to the extent where he ended up turning off Sheila Jackson Lee’s microphone. I fully expect Pence to be just as rigid in enforcing the rules.

This Georgia evidence and the testimony at the hearing was featured prominently on Mark Levin’s show yesterday, and it was damning.

But will anything really be done about it? That’s doubtful to me at this point. I’m hoping and praying otherwise.

Unfortunately, I think what LS is describing is actually the most likely scenario. (and hope he’s wrong about only getting vote support from 10 senators).It’s the procedure straight out of the 1887 Electoral Count Act, which prescribes “safe harbor” procedures for states to submit and certify their Electoral College votes.

Personally i think in 1887 congress should have made an amendment instead of a statute but perhaps they considered this and thought it would withstand a constitutional challenge.
It seems the only way to beat this law is with a constitutional challenge which is what Gohmert in Texas is trying. I hope and pray for it to succeed but won’t be holding my breath.

If Brooks and Hawley want to play out this string, they can object to each state's slate of presented Electors and force as many as 51 full 2-hour recesses, and compel voting on each successful Objection.

They. can. compel. There is nothing Pence or anyone else can do about it.

Clearly, there is now a substantive plan to maximize these rule-of-order recesses to illegitimatize the puppet-state installation.

That means Brooks and Hawley and all of the GOP that are all-in, hit the MSM cameras each time with specific allegations of fraud for each state they Object to.

So a successful strategy would be to drag the event into the evening news and force it to be covered live. AZ, GA, and finally PA, at 2 hours each, would accomplish that task.

Of course it's over. It's always been over. Been saying this for weeks and gotten yelled at every time.

The Powers-That-Be DO NOT WANT TRUMP. They never wanted him, and never expected his win. That is why both parties didn't just conspire to take him out, but worked openly to do so. First via CIA/FBI, then Flynn, Sessions, Mueller. All pushed hard by Graham and Senate Intel committee.

ANYTHING that gets put into Congress is a guaranteed loss for Trump.

America is Babylon. It is Rome. God is clearly fed up with us.

I haven’t read the briefing on Gohmert’s case, but I have a hard time seeing how the Electoral Count Act is not authorized by the Necessary and Proper Clause. I also have a hard time seeing how this lawsuit—in which a congressman is suing the vice president to ask the court to tell the vice president what his powers are—presents a live, justiciable controversy.

An up-or-down vote on disputed electors after a cursory debate would be hard to decide. Even I might vote Present.

What should happen is a secondary motion to go into committee of the whole, or to establish a committee to investigate and report back. This motion will also fail, but will provide a better definition of each congressperson’s treason.

If the motion to go to committee fails, then a subsequent up-or-down vote on the electors would be easier to decide. Democrats don’t want to examine the evidence, therefore the electors should be cast aside.

Furthermore, each state should be considered separately, so this process should repeat for at least 12 hours, not the 2 hours currently envisaged.

They can’t do that. 12th amendment specifies the “ President of the Senate“ and Article one assigns that title to the VP. Since there is no vacancy in that office, only Pence can preside.

My reading is that Pence’s role is largely ceremonial, he cannot act independently like so many are pushing for. Since there do not seem to be any state certified competing slates, and no court intervention, this looks like a done deal for Biden. There will not be majorities to reject AZ, PA, GA, etc. The objections will be a footnote in history but will put forth whatever facts exist about irregularities or illegalities. But these better be facts, not conspiracies and supposition.

POTUS has had two months to build his case and I am still waiting for the proverbial “smoking gun” that would tell me the Democrats didn’t just game the system with procedural changes and produce substantial low information mail ballot voters for their candidates.

I’ve seen the GA video, I am aware of PA ignoring Alito’s order, I am aware of other rule and procedural changes without legislative changes but is it enough? The courts, even a full panel of GOP judges including a Trump appointee, have found the president’s arguments wanting even when he was found to have standing.

It’s ridiculous to watch standing and laches apply when preelection cases are dismissed because they aren’t ripe. How can you not sue because the election isn’t certified but you also can’t sue because the election has been certified. It feels like that’s where some of this legal maneuvering is.

I do not doubt, in the absence of Covid and the cover it gave for alterations in the normal course of elections, that Trump would have been re-elected. But here we are. If Pence attempted to set aside slates of electors by his own accord, I would expect him to be impeached and removed from office.

It seems highly improbable enough electoral votes would be successfully challenged to force the election to be decided by House state delegations.

We should not underestimate the cowardice of politicians, or judges at this point. It is not coincidental that the media and officials warned of potential civil unrest based on the results of the election. Notice that when it appeared the president was not reelected there was no unrest. In my mind the suggestion there could be unrest depending on the outcome was itself election interference

There will be hundreds of thousands of Trump supporters in DC next Wednesday and many of them will have made personal sacrifices to be there, be it missing work, sleeping in their cars, dealing with traffic and parking challenges, enduring the elements by waiting for hours outside, etc.

If all of this is merely for Trump to concede and announce his 2024 campaign, there will be a lot of very disappointed (and put out) people there. It will be like being told to drink our Ovaltine.

So I do not believe this is the purpose of calling us all down there.
