Sen. Josh Hawley of Missouri joined with a host of fellow Republicans Monday to introduce a resolution allowing the chamber to dismiss articles of impeachment against President Trump for lack of prosecution, as House Speaker Nancy Pelosi delays sending the case for trial. The resolution specifically would update Senate rules to allow the chamber to bring a motion dismissing the articles.

Senate rules can be changed by a simple majority vote.

You’re thinking of legislation to clear a filibuster which only requires 60 votes.

Maybe.

According to the Supreme Court’s ruling in United States v. Ballin (1892), Senate rules can be changed by a simple majority vote. Nevertheless, under current Senate rules, a rule change could itself be filibustered, requiring two-thirds of senators who are present and voting to end debate.

First, there are enough grandstanding assholes like Romney to put a simple majority in question, and second, Mitch might not exercise the nuke option to kill the filibuster.

Pretty sure this is a 51 vote deal.

Yes, but only if they go the “nuclear option” route which, while possible, is rare.

Yeah. If they try again it’s called abuse of process should be a provision to deal with that and repercussions to House speaker herself such as contempt of Congress. Grow some cohones Repubs. Hold her personally accountable.

“Pelosi and others said they will just bring them again.”

Dismiss with prejudice, which means that they cannot re-impeach on the same charges or any other charge that could have been included in the articles of impeachment.

This’ll go on and on and on all thru Trump’s 2nd term, impeachment session after impeachment session after impeachment session after impeachment session. It’ll never end.

Only one bite at the apple will be allowed by the Republican Senate.

The insanity of the House Dems has been completely uncorked--but there is a simple Legislative solution by the grown-up Republicans in the Upper Body.

Since the United States Constitution allows the Senate absolute authority to create its own rules in an Impeachment, the Senate can create a rule stating: "Due to a Democrat-controlled House submitting a series of frivolous, merit-less, expensive, and time-consuming Impeachment Articles, all subsequent Articles submitted by the House will result in an immediate acquittal and dismissal of the charges."

This Senate Rule would mean that each and every new article of Impeachment submitted by Pelosi from the Dem House would carry--implicit within it--an instantaneous acquittal of the President.

This new Rule can be removed when sanity again prevails in the United States House of Representatives.

They can keep doing this until November. The more the Democrats are on the record for stuff the better.

“If they’re not confident of their case, they shouldn’t have impeached Trump in the first place.

Its not a sign of strength House Democrats can’t name their managers and report to the Senate, ready to proceed to trial.

Just the opposite.”

Oh I don’t think it is a position of strength, they will just keep it up until voted out. They cannot help themselves and they are afraid of their base.

The next congressional election doesn’t hinge on the 4% of seats from California.

Good rule, but it won’t stop them and their media whores from endlessly pursuing it.

Here’s a scenario, she holds the articles, adds to them and then after Trump wins by a landslide, re-enters them. She wants to throw the election. Nancy is an evil bitch.

Agree, if it takes a nuke option to make it happen the odds are slim with Mitt and the other girls standing in the way. This despite the fact the Senate already voted that the house process was a rancid POS. That is as forgotten as Graham’s DOA declaration.

Courts have no say/jurisdiction in the impeachment process.

She said it was urgent business to impeach Trump because of the “damage he is doing to the country”. Then once done, she changed her tune.
