National Guardsman Breaks Rank On Dems Virginia Gun Control: ‘We Will Not Comply’

Over the last few months, Virginia Democrats have worked to pass extreme gun control measures in the state. In fact, a Democratic congressmen went as far as to say that the National Guard my have to be used in order to enforce a door-to-door gun grab.

“And ultimately, I’m not the governor, but the governor may have to nationalize the National Guard to enforce the law,” Rep. Donald McEachin said, according to Newsweek. “That’s his call, because I don’t know how serious these counties are and how severe the violations of law will be. But that’s obviously an option he has.”

However, one National Guardsman — who opted to remain anonymous — will not be going along with state’s prospective gun control measures, writing a direct letter to McEachin that “we will not comply.”

Here’s the letter, per Law Enforcement Today:

Mr. McEachin, have you ever heard of a little thing called the Posse Comitatus Act of 1878? Apparently, you are not.

Allow me to fill you in.

The purpose of the act is to limit the military branches from enforcing laws against US. citizens. While the PCA does not prevent a governor from calling the Virginia National Guard, the law enforcement capacity of the Guard while on state active duty is full-scale enforcement of martial law when local law enforcement can no longer maintain civilian control.

Are you listening Mr. McEachin? If Governor Northam were to call up the National Guard, it would be through enacting martial law. …

Martial law is the imposition of direct military control of normal civilian functions by a government, especially in response to a temporary emergency such as invasion or major disaster, or in an occupied territory.

Sheriffs and police chiefs refusing to go against the Constitution to fulfill your stupid anti-gun drivel hardly constitutes a temporary emergency.

If you and your fellow Constitution-hating hacks continue to push an agenda of gun banning, forfeiture and confiscation, I can almost assure you that you might meet more than one requirement for enacting martial law.

If you force local law enforcement to start violating peoples 2nd Amendment rights by taking their guns, you will wind up with temporary emergency due to an occupied territory.

If the state deems that it should enact martial law because sheriff’s, whose only “crime” is standing up for the Constitution, here is what it looks like.

The state Constitution would be suspended. So would habeas corpus and civil rights.

There would be no freedom of the press, assembly or speech.

Curfews would be enforced on the people.

Troops would be in the streets for enforcement.

Checkpoints would be set up for control.

The Guard would have the ability to hold a person without charge.

Imprisonment without representation or due process.

Seeing that we are talking about gun control, there would be warrantless, house to house confiscation of firearms, ammunition, food supplies.

I have to wonder if this is really what Democratic leaders in Virginia want. Because what it equates to is a tyrannical government using its military as ‘enforcers.’

And that is exactly what the 2nd Amendment was created to protect against.

If the Virginia legislators want to push this issue, it could get ugly.

And oh, by the way, plan on seeing the vast majority of the Virginia National Guard become Conscientious Objectors. It will be really hard for them to arrest cops and confiscate guns when none of them will carry the necessary arms to enforce said arrests and confiscations.

How do I know this? I am one of them and will be one of the first to lay down my gun and walk away.

I will not be a pawn in a tyrannical game of human chess. Neither will most of the men and women I serve with.

As a future potential juror, I’m already a “not guilty” for any person charged for violating any gun confiscation ordinance. As democrat leadership nationally supports the wholesale abrogation of certain US rights, AND the protection of illegal invaders, I’m also a “not guilty” in any charge brought forth against any person for a crime committed against any elected democrat OR their family member. One needs to be at risk for the results of their official acts.

If “Comfortable” Ralph thinks he can employ the national guard, President Trump can nationalize the guard to enforce the US Constitution.

i would hope that in the case of martial law, the national guard would arrest those violating the 2A and insisting on the forfeiture of constitutional rights of the citizens... and then by the powers invested in the fourteenth amendment section 3, throw those in rebellion against the constitution out of office.

I’d love to see their called up guard federalized, with orders to arrest those who forced this situation, starting with the governor on down, then prosecuted on civil rights charges.

This Governor has already acknowledged that he lacks the executive judgment that prevents 99.8% of us from doing blackface for the express purpose of a college yearbook.

This Governor had to be prevented by his wife from moonwalking at the press conference about his blackface.

So to see him light a match on this powderkeg? I'd take him at his word. So you Virginian's must exhaust every legal remedy.

Before serving for ten years,I took an oath to defend the constitution against ALL enemies,foreign or DOMESTIC.The second amendment says CLEARLY that the right to keep (have)and bear (carry) shall not be infringed upon.If given,this order is clearly illegal,and should not be followed...

While I applaud the sentiment of the letter, it’s not the appropriate argument. Bottom line is ALL military and law enforcement have a duty NOT to obey unlawful orders. Glad Virginians are standing up. What a different world it might be if Californians and New Yorkers had done the same decades ago.

What I think of his letter?

Hard read. I appreciate his passion but perhaps he should have had a friend read his letter first.

"I am one of them and will be one of the first to lay down my gun and walk away."

Perhaps a better statement would be, "I will keep my National Guard issued gun and protect my neighbors right to keep his too."

These Democrats believe that they are enforcing the will of the people that voted for them.

Therefore all of these Democrats, Independents and Rinos that voted for these leaders should turn in any firearms in their possession and follow their leaders in disarming.

They can then post large “ GUN FREE ZONE” signs all over private and Government properties and live without fear.
A win-win for all.

NATIONALIZE? While a governor may call out the National Guard for in state emergencies, I believe it is only the President of the US who can “Nationalize” the guard, putting them under Federal Control as Eisenhower did back in 1957 Little Rock.

It is, but that's not an excuse not to start the Petition. A good solid GOP candidate -- maybe just a regular guy who cares about the Constitution -- could align themselves with recall and build a hella nice dbase and actually get to know real grassroots 2A defenders.

For that reason ALONE, someone needs to begin a Petition THIS YEAR so that the Petition will apply under current rules, because I guarantee the Democrats will monkey with those rules starting Jan. 8.

Petitioning is not that hard. There's one going in Colorado right now to recall Polis.

That’s what I’ve been saying for a while now. It doesn’t matter what the perfumed princes of the five sided puzzle palace do or say, the field grade officers along with the rank and file will not follow any such illegal order.

My daughter lives in Charlottesville. She’s gotten quite an education this week about the sanctuary movement as we drove 700 miles together.

She’s a gun owner but between work, school and church hasn’t had much time in the last few months to pay attention to this stuff.

As expected, in Charlottesville (Berkeley East) and Albermarle County, there is absolutely no possibility of them getting on the train.
