Trump Impeachment Trial in Doubt as Democrats Weigh Withholding Articles

WASHINGTON — The day after the House cast historic votes to impeach President Trump, Speaker Nancy Pelosi put an abrupt halt on the proceedings, holding back from sending the charges to the Republican-led Senate in a politically risky bid to exert influence over the contours of an election-year trial.

With some leading Democrats pushing to delay transmittal of the articles and others advocating that they be withheld altogether, the limbo is likely to persist until the new year. The House left town on Thursday for a two-week holiday recess without taking the votes to appoint impeachment managers, which is required to start the process in the Senate.

“We are ready,” said Ms. Pelosi, who has said she would not send the charges or name the lawmakers who would prosecute the case against Mr. Trump until she was certain of a fair process for a Senate trial. “When we see what they have, we will know who and how many we will send over.”

By withholding the articles, Ms. Pelosi is hoping that Mr. Trump — who is eager for a trial to present his defense and clear his name — will put pressure on Senator Mitch McConnell, Republican of Kentucky and the majority leader, to commit to Democratic demands, including the ability to call witnesses during the trial.

But the speaker’s strategy is also a gamble. Having toiled to present the House impeachment inquiry and the votes on Wednesday as a somber duty rooted in the Constitution, Ms. Pelosi risks appearing to politicize the matter if she withholds the charges for negotiating leverage.

And Mr. McConnell was entirely unmoved by Ms. Pelosi’s tactics, delivering a speech on Thursday evening in which he appeared barely able to contain his amusement at what he regarded as the speaker’s missteps.

Very uncouth of the NYT to let that stand. The level of respect afforded to another is an indicator of one’s own character, not another’s.

Being respectful toward someone isn’t an indication of your feelings toward that one. It is however, a clear indication of who YOU are. Your character.

They basically want to turn the 2020 Election into a referendum on Impeachment.

I could be wrong but I think that would be the absolute worst thing the Dems could do to themselves.

One of the recollections I had of the Clinton Impeachment process was they had information developed that was not used or “disclosed”. Since no one in Washington can keep a salacious detail unspoken, IIRC there were 4 rape allegations in the boxes in the Ford Office Building only to be open after 50 years I believe. At the time, they believed his conviction was certain, and they were wrong of course.

There was no impeachment until a “Letter of Transmittal” detailing the Articles and the spelling out of the House prosecutors is received by the Senate.
Zero, zilch, nada.
This is a very, very dangerous time for Trump. Somebody might at one of his rallies or something try to make it “personal” if u know what I mean...

Today I read this from New Jersey Joe

McConnell should declare something like this:

“Because the articles of impeachment have been made publicly available, the Senate deems them ‘delivered’ — the House has six hours for their managers to present themselves to participate in the process. Otherwise, we will begin without them, and no one will be allowed to join the process once we’ve started.”

They can do this, but McConnell cannot deem it, they have to vote to change senate rules, which currently require formal transferrance and assignment of house managers....

Again I will point out that I did not watch the circus in the House.

However, I did see Nancy presiding over a meeting of the House. I did see her make some statement or other concerning articles of impeachment and I did see her strike her gavel a couple of times.

These parliamentary steps have significance. If the House passed articles of impeachment by the Constitutionally required majority that has great significance. If such resolutions as were passed constitute impeachment, then Donald Trump is impeached and the Senate then has the power to hold a trial.

If what happened in the House constitutes impeachment, then Nancy has no power to negate it. If what happened is not impeachment, then Nancy has no power to bring impeachment about.
