Kamala Harris And Brett Kavanaugh Had A Very Weird Exchange At His Confirmation Hearing
buzzfeednews.com ^ | 9/6/18 | Chris Geidner

More than 12 hours into Judge Brett Kavanaugh's Supreme Court confirmation hearing on Wednesday, Sen. Kamala Harris raised a question about Special Counsel Robert Mueller's investigation that appeared to take everyone by surprise.

"Have you ever discussed Special Counsel Mueller or his investigation with anyone?" Harris asked, prompting Kavanaugh to note that the topic is "in the news everyday" and that he had discussed it "with other judges."

Then, however, Harris shifted to a far more direct question: "Have you discussed Mueller or his investigation with anyone at Kasowitz Benson and Torres, the law firm found by Marc Kasowitz, President Trump's personal lawyer?"

And though that question amounted to a near-accusation that the senator never quite made, Kavanaugh also was unable to give a direct answer — leaving the issue unresolved going into Thursday, what will be the third day of Kavanaugh's confirmation hearing.

Nothing about such a communication between Kavanaugh and a lawyer from the Kasowitz firm has been reported previously, and the White House did not immediately respond to a request for comment on the exchange.

“I don’t recall” is the Hillary-tested, Hillary-approved answer.

When will our side get it ?

Repeat after me:, I DON’T RECALL.

Are you Harris’ alter ego. These are gigantic firms and it would be foolhardy to go for an easy answer when the truth is that you don’t know all the lawyers that work there or have worked there in the last 3 years. Kavanaugh was careful and precise.

needs to answer the flipping question

Seriously, answer a loaded question with who knows what name behind it? There are dozens of attorneys at each of the hundreds of agencies in and around DC. She could have one person in mind, who mentioned an off hand remark to Kavanaugh about Mueller at some kind of conference, dinner, luncheon, etc. Then, when he says "no", he has perjured himself because he didn't know this particular attorney worked there.

Wow, you are beating a dead horse, do you have skin in the game? You are incorrect. Never answer open ended questions when someone is inviting you into a perjury trap. It’s on Harris not Kavanaugh.

> Harris is a pitbull prosecutor type.

Who got her job by sleeping with Willie Brown, not by merit.

So she’s unlikely to be very good at being a “pitbull prosecutor” type and more likely to be just another backdoor-accusing leftwing hack.

What conversation and with whom? Kavanaugh could have had multiple conversations on the subject with several people. Harris should stop being coy and state her allegation specifically. The burden is on her, not Kavanaugh. Get a grip.

Of course she came off just as you describe, but the point is, Kavanaugh is the one that is being interviewed, not that wingnut Harris. And Kavanaugh did not look good during that exchange.

Give it a rest! The man spent 12 hours being grilled by a pack of Jackals. He turned the question on her, said be specific. She couldn't or wouldn't.

Opinions outside the courtroom are not illegal either.

Deshowitz is constantly commenting, engaging in conversations on Mueller and everyone else...Comey, Yates, Rosenstein etc....but is very explicit...I am NOT advising the President.

What do you mean he didn’t look good? He looked confused. How would he know everyone he may have talked to about the investigation. It’s a topic in Washington, everybody is talking about it.

It would be like asking you if you ever discussed something with somebody in your neighborhood.

There are a million lawyers in DC, they play musical offices on a moments notice

If she could have got that, he would have had to recuse himself if that case ever (and it may possibly do so) come to the Supreme Court.

Would he? Kagan literally shepherded the ACA through approval on behalf of the obama administration. After taking her place on the SC, she did not recuse herself from the case deciding the constitutionality of the law.

Prevaricate is to evade the truth. I did not read it that way. I read it as the behavior of someone knowing a trap is being set and not wanting to be sandbagged with a conversation they don’t remember, that was in a group, meeting, society luncheon etc where Kavanaugh may have been part of a multi-member discussion where he was unaware of the employment status of every individual.

That situation would make you appear wary but it is not on Kavanaugh but on Harris & the process.

Just look at the damned question (the bold and highlighted items are mine):

"Have you discussed Mueller OR his investigation with anyone at Kasowitz Benson and Torres, the law firm found by Marc Kasowitz, President Trump's personal lawyer?"

Mueller was the Director of the FBI and the Deputy Attorney General for years. Kavanaugh could have had a conversation with a lawyer from that firm about Mueller in either of those capacities 10-15 years ago.

He knows if he went there and talked about it. Or he should say, “I have been to social gatherings and talked on a conversational level about Mueller, but nothing official. “ If that is what is true. If he was consulting on the Mueller question, then say so. I mean, it’s not that hard to tell the truth. In fact, it’s a lot easier than trying to skate around something.

I can see her motive. However, a non-answer to an ambiguous question about an unknown person, is proper. In other words, he's not going to guess who she's talking about.

She has nothing.....If she had something it should be a direct question....Have you ever advised the President regarding the Mueller witch hunt?

In other words, she's running her own little witch hunt.

It was more than weird. It was the most ill- disguised trap ever set, like an angry nanny asking a kid about a missing piece of pie in the fridge. These senators have forgotten that they are talking to a federal judge, not a college freshman.

Lawyers go from law firm to law firm all the time. Did he speak to a former partner or a current partner? He needs a time frame and a name to answer the viper's question correctly.

No....He did just fine....There is no good answer to an ambiguous question about an “anonymous” contact.
