I know they do, but a lot of older, more traditional Catholics still frown on the practice. Knowing what I do about Scalia, I am guessing he was one of them.

The Catholic Church has allowed cremation for many years.

There is some question as to whether a US citizen can be tried by a military tribunal. My current understanding is that the US has to be in a state of war in order to be able to so.
