Why ObamaCare Cannot Simply Be Repealed… (Dont get PO at not total repeal. Not possible till 18)

FACT: ObamaCare was passed, using the original legislative vehicle, at 1:38am on 12/23/09 with 60 votes in the Senate. The House then approved that Senate Bill without changes; and in February 2010 created a secondary bill which created the opportunity for the Senate to modify ObamaCare using “reconciliation” for a lower vote threshold of 51 votes.

[Understand the full construct by reading HERE] If you do not understand how legislation is created; if you do not understand the difference between the Senate and House; if you do not understand the way ObamaCare was created, you really need to read this first.

A clean repeal bill, meaning a law to repeal the entire ObamaCare construct only, would require another 60 vote hurdle in the Senate.

Republicans, while in the majority, only control 52 seats. Without 8 Democrats voting to approve a “repeal bill”, any House (Or Senate) bill that repeals ObamaCare cannot pass the Senate.

This is why Mark Levin is a con-man; selling snake oil as outrage to keep a listening audience angry, yet clueless and hopeless. That’s what I don’t like.

A complete repeal of ObamaCare is currently impossible. The House Freedom Caucus can push all the repeal bills they want, but they cannot get a repeal bill through the Senate because they cannot get the 60 votes needed. Period.

A complete independent repeal bill of ObamaCare is currently impossible.

I’m afraid that would be a bridge too far even at this time.

No it's not because healthcare costs are completely unsustainable.

Either we have single-payer, or it should crash and burn and market forces take over.

Many of you want to kick the can down the road and buy into this ridiculous, asinine notion that Republicans need to "repair" Obamacare so the media/Dems won't call them meanies.

I prefer a clean repeal bill, passed according to the Constitution. So what if we don't have 60 votes? Then run in 2018 and tell the people how Obamacare is still killing the healthcare industry. The Dems fingerprints will still be on it. Why would you want Republicans fingerprints on it?

I three different threads today I have been in agreement that whatever gets produced, the media will make it Trump’s. The idea of doing nothing for two years is almost equally disgusting.

the bill is a tax (scotus said so) and was created in reconciliation which required 51 votes. my take is if it was created in reconciliation it can be repealed in reconciliation. pubs are just stupid.

Yes, technically, but I’ve seen examples of filibuster by unlimited debate (the old ‘Jimmy Stewart style’) in the very early Senate. I consider whatever the Founders did as ‘prima facie’ “Constitutional”.
Didn’t save them but will look out for them again since the subject will be ‘hot’.

The bill unveiled today isn't even one of the three phases. It's the House version of a bill that probably won't go anywhere in the Senate.

I'm not terribly upset about what was rolled out today because I understand that this is a political process. I really believe both houses are going to end up passing versions of a bill that gets a lot of Democrat support -- mainly because nobody in reasonably good health can afford their 2017 premiums anyway and ObamaCare is basically dead for all intents and purposes.

That's the thing. The moment Trump signs RyanCare, it'll become TrumpCare and the Dems/media will trot out the sob stories of people who lost their ObamaCare coverage and run ads in 2018.

Like I said - just have a simple repeal vote and let the chips fall where they may be. There should be no pressure on Republicans to fix or repair Obamacare, since none of them didn't vote for it.
