FACT: ObamaCare was passed, using the original legislative vehicle, at 1:38am on 12/23/09 with 60 votes in the Senate. The House then approved that Senate Bill without changes; and in February 2010 created a secondary bill which created the opportunity for the Senate to modify ObamaCare using reconciliation for a lower vote threshold of 51 votes.
[Understand the full construct by reading HERE] If you do not understand how legislation is created; if you do not understand the difference between the Senate and House; if you do not understand the way ObamaCare was created, you really need to read this first.
A clean repeal bill, meaning a law to repeal the entire ObamaCare construct only, would require another 60 vote hurdle in the Senate.
Republicans, while in the majority, only control 52 seats. Without 8 Democrats voting to approve a repeal bill, any House (Or Senate) bill that repeals ObamaCare cannot pass the Senate.
This is why Mark Levin is a con-man; selling snake oil as outrage to keep a listening audience angry, yet clueless and hopeless. Thats what I dont like.
A complete repeal of ObamaCare is currently impossible. The House Freedom Caucus can push all the repeal bills they want, but they cannot get a repeal bill through the Senate because they cannot get the 60 votes needed. Period.
A complete independent repeal bill of ObamaCare is currently impossible.

True, even this first step will get tweeked.
BS. They simply do not have the will. Stop the nonsense. Rinos are in power yet they act as if the RATS are setting every rule and agenda. Enough!!!!!
Kick the can down the road?
“Sure we’ll cut spending, 15 years from now”
PASS THE RIGHT BILLS NOW
Since the Supreme Court deemed it a tax-type situation...the 60-rule doesn’t apply in this. Only 50 or more. The replacement bill, as I’ve read it, is mostly a tax-bill as well.
Now all of a sudden CTH is concerned about rules, Senate deliberations, Paul Ryan and process when Harry Reid completely destroyed those very rules to get Obamacare passed.
I say simply put a complete repeal up for a vote...and if Dems and RINOs vote against it, so be it....and then have Trump and HHS nuke all the exemptions and force everyone and their Momma go on Obamacare.
Bottom line: Republicans have no testicles.
Much of ObamaCare was basically repealed once the Trump administration announced that the IRS would no longer require taxpayers to file those stupid forms that verified your insurance coverage.
The next step to "replace" ObamaCare is for some enterprising people to come up with a financial/insurance product that mirrors all the good things people enjoy about medical insurance without the bad sh!t that makes it expensive and onerously administered. Start marketing it to the public in a state that doesn't mind telling the Federal government to "F%$& off!" (I'm thinking Kentucky might be an ideal place for a number of reasons). Ten bucks says the Federal government won't do a damn thing about it. Congress will probably thank you for getting the issue off their desks without forcing them to vote on anything.
The first assumption is, If we pass ObamaCare-Lite now, the GOP retains control of the House and Senate in 2018. The second assumption is, If GOP retains control in 2018, they’ll have the stomach to take up the issue again.
I’ll grant the first, since the Dems are so badly positioned in Senate races. But the second? No way. And the party that owns ObamaCare-Lite in 2020 (GOP) gets slaughtered.
They could repeal obamacare anytime at all. It is a matter of will.
I'd bet if it was a pay raise they could get that done even if every Democrat was opposed.
Thank you!! I had forgotten how fiendishly convoluted that whole process was. I just wish the Repubs would be that tenacious in their dealings!
Why not have President Trump make changes to it like Obuma was doing while he was there then abolish the dad gum thing.
He's pretty much right about the repeal process though.
BULL$HIT
THEY USED TRICKERY TO PASS IT- THEN WE USE THE SAME TRICKERY TO REPEAL IT
Well Trump ran on and won by promising to “repeal AND REPLACE” Obamacare with something better. The only guy saying “repeal every word” was Cruz and he lost. So the debate about whether there should be a national healthcare progrem and whether it’s constitutional is over. We lost those battles, now the issue is how to restructure it to eliminate some of the most odious parts of Obamacare, stop the crippling effect it has on business, and try to find actual cost savings and efficiencies that can get to the real root of the issue and bring the cost of healthcare down for everyone.
That’s it.
I share the outrage but he’s right.
Any one who thinks Democrats are going to vote to scrap Obamacare are not dealing with reality. 60 votes to get a complete repeal through the Senate aren’t there.
That’s why the President and the Congressional leadership want to take it one step at a time.
A lot of conservatives want all or nothing. That’s self-defeating because it kills the possibility of real change down the road.
Rome wasn’t built in a day and neither was Obamacare. Getting rid of it will require hard work, time and patience.
In 2018, the GOP can go to the voters, give us a Senate supermajority to finish the job.
But you don’t put the horse before the cart. If conservatives can’t support incremental repeal, then Obamacare will stay with us.
Exactly what the Democrats want. Let’s not fall into that trap.
I read the article, you quoting it doesn’t change my opinion of it.
Wow, great summary!
Yes do what they did! Use a shell of another bill and reconciliation! Just do it! We can’t keep trying to play by the rules against an enemy that is dismantling our country! There will be nothing left if we keep this up!
That's why conservative and conservative groups are up in arms over this. This is a historic opportunity that may never happen again.
The Feds should get completely out of health-care, except for active-duty and retired military veterans, and of course existing Seniors, and even then those seniors CMS should be block-granted to the states so the states can run Medicare/Medicaid, not the Feds.
Just completely free-market the healthcare system. Enough of these mandates, subsidies, regulations, etc.
