Glenn Greenwald: The FBI was right not to arrest Omar Mateen before the shooting
Washington Post ^ | June 17, 2016 | Glenn Greenwald

Citizens should not forfeit their rights if they haven't committed a crime.

The massacre at an Orlando LGBT club has predictably provoked the same reaction as past terror attacks: recriminations that authorities should have done more to stop it in advance, accompanied by demands for new police powers to prevent future ones. Blame-assigners immediately pointed to the FBI's investigation of the Orlando shooter, Omar Mateen. "The FBI closed this file because the Obama administration treats radical Islamic threats as common crimes," GOP Sen. Lindsey O. Graham argued on Fox News. "If we kept the file open and we saw what he was up to, I think we could have stopped it." Others cited core fundamental rights, demanding they be eroded. "Due process is what's killing us right now," proclaimed Democratic Sen. Joe Manchin about the FBI's inability to act more aggressively against Mateen.

Ever since the Sept. 11 attack almost 15 years ago, every act of perceived terror, and even thwarted ones, have triggered identical responses.

Agreed. The general principle is sound.

I just don’t like the hypocrisy when some white guy does mass murder. Or the constant haranguing for gun confiscation.

The FBI failed on this very badly. It was the “Rules od Engagement” and political correctness that once again killed many innocent Americans. All of these killers were Wahhabi Sect Sunnis but we don’t have a clue?

Actually, they made more sense post-911 than the NYT, where most of the atrocity occurred.

He had also been arrested for other things. There were numerous red flags.

We were a better country when we were racist enough to round up those of dubious loyalty after being attacked! Now we have ongoing attacks without end! There were no Kamikaze or other attacks here back when we were a racist country! Racism is moral because it protects those like little 8-year-old Martin Richard at the Boston marathon finish line from naturalized Mohammedans!

Did the FBI interview him? Did they get a judge to approve a wire tap? Did they put put him under surveillance? None of those things violate a person’s rights and could have prevented the latest Muslim massacre.

Obama’s a piece of America hating trash, but at least he isn’t Islamophobic.

His domestic violence and mental illness issues never made it to the NICS process to preclude his purchases or revoke his existing licenses. Government regulation is pointless if it is not implemented.

So the best we have is wait for a terrorist scumbag to shoot up the place, and then the government can say, yup, we had him under surveillance. For Pete’s sake, the only chance anyone has, under those conditions, is to be armed.

Not “arrest” - “detain” is a more appropriate action. Perhaps an internal exile from the Orlando area may have been an alternative action. He was clearly a very unhappy employee where he was at, and made an uncomfortable work environment for his co-workers.

Yes, I agree. But, from what I've seen -- the FBI did drop the ball here, because the guy was certainly acting suspiciously AND was reported.

When a guy that has been investigated for terroristic threats and was given a pass because he was Islamic, and THEN is reported trying to buy body armor and a lot of ammo, I would think at least a yellow flag should have been thrown.

The FBI does NOT have the resources to watch the thousands of suspicious people on these garbage lists, not to mention they decided he could be taken off. What we need are internment camps!

Yes the FBI could have hauled him in for additional interviews and also shadowed him.

The problem is that this goon was not a legitimate citizen.

Read the fine print on your US passport. It cites the laws under which you forfeit your US citizenship. Among them is training or serving with a foreign fighting force.

Mateen’s stint with the Taliban in Afghanistan is enough for him to have forfeited his US citizenship.

He should never have been allowed reentry into the US, since DHS and FBI both knew about him training with the Taliban.

Yes, and all of them located in the Middle East.
