Scalia's death to be ruled a heart attack

MARFA, Texas -- United States Supreme Court Justice Antonin Scalia's heart stopped beating during his sleep, Presidio County Judge Cinderela Guevara told WFAA on Sunday.

Guevara officially pronounced him dead at 1:52 p.m. on Saturday. She will be the local official who signs his death certificate.

Hours earlier, the county judge told WFAA that myocardial infarction -- or a heart attack -- would likely be the cause of death listed. Guevara later said she would confer with the Justice's personal physician on what specifically to show as the cause of death....

An “autopsy” by a sitting Democrat judge is unacceptable.

No, I found my husband dead in bed when I came home from work.
He had been dead for awhile because he was cold and a little
stiff but no bladder or bowel movements.

I still think Justice Scalia should have had an autopsy. I
wonder why his family said “no”. But then, when a family is
in grief, the thought of someone cutting your love one can
be overwhelming.

Well, if they took a blood sample, there would have been a chemical present to indicate a heart attack.

I just wish they would tell us.

The way this was handled just looks amateurish and will give fodder to conspiracy theorists for a very long time if Obama makes a power grab or a critical nomination that tips the balance of the court for a generation.

The judge may have had the authority to do this, I don’t know. But it’s not something that would have happened if a president would have died under similar circumstances.

It is permissible under Texas law. LEO were on scene. They told the JP(the coroner) there were no signs of foul play. This is not unusual in any death that occurs.

The conspiracy nuts are running amok. Stop it and act like a grown up

How could the judge determine without even seeing the body whether or not an autopsy is necessary to determine or confirm the nature and cause of death?

Art. 49.10. AUTOPSIES AND TESTS.

(e) A justice of the peace shall order an autopsy performed on a body if: (1) the justice determines that an autopsy is necessary to determine or confirm the nature and cause of death;

(i) If a justice of the peace determines that a complete autopsy is unnecessary to confirm or determine the cause of death, the justice may order a physician to take or remove from a body a sample of body fluids, tissues, or organs in order to determine the nature and cause of death.

The man was dead. Of course the JP said his heart quit beating because it did. That is not a diagnostic but a fact.

The family did not want an autopsy

His physician was not shocked by his passing

All of you conspiracy nuts need to cool your jets. How many of you have had an autopsy on a family member? Probably not many. Autopsy is unusual after death.

Remove the name Scalia and this is a nothing story

I am not alleging there was or was not any “conspiracy”. I am pointing out irregularities.

The judge performed the inquest because the cause of death was unknown. So far so good.[1]

How did the judge determine whether or not an autopsy was necessary to determine or confirm the nature and cause of death?[2]

The judge did not see the body, how could she make such a determination? Apparently she relied on statements from LEO who arrived on scene after the death. Did LEO determine the cause of death?

[1] Tex. Code Crim. Proc. Art. 49.04 (a) A justice of the peace shall conduct an inquest into the death of a person who dies in the county served by the justice if: (3) the body or a body part of a person is found, the cause or circumstances of death are unknown

[2] Tex. Code Crim. Proc. Art. 49.10. (e) A justice of the peace shall order an autopsy performed on a body if: (1) the justice determines that an autopsy is necessary to determine or confirm the nature and cause of death;

[3] Tex. Code Crim. Proc. Art. 49.01 (2) “Inquest” means an investigation into the cause and circumstances of the death of a person, and a determination, made with or without a formal court hearing, as to whether the death was caused by an unlawful act or omission.

The body was found in the morning after Scalia did not show up for breakfast. The body was moved to El Paso at 3 AM.

That’s at least 18 hours.

During that time neither of the two JP’s nor the County Judge on whom the duty devolves saw the body.

In all that time the County Judge did not see the body and, without an autopsy to determine the cause of death of the found body, literally phones it in that the cause of death is “natural”.

The way it usually happens. They call the attending physician if there is one (in this case there was a doc of record) and the JP talked to the responding LEO

That is usually all that happens

Take Scalia’s name and change it to Smith this would have been handled the same way.

JP did not talk to LEO, the County Judge did. But more to the point: this is not John Smith private citizen, this is Antonin Scalia, Associate Justice of the Supreme Court of the United States.
