I also found this very very timely in light of Trump's immigration proposal. When Trump says he wants to repeal birthright citizenship he means he can do it through congress and does not have to go through the courts. This show was an amazing eye opener. Levin sure seems to be confirming what Trump wants to do.

I’m not arguing that he’s wrong in his conclusion, but if there is a conflict between Article I, section 8 and the 14th Amendment, the latter would negate the former in that case. That’s how amendments work.

Levin's point that an illegal is not under the jurisdiction of our government is totally valid. If the illegal gave himself over to US jurisdiction he would be detained and deported back to the country that does have valid jurisdiction. The illegal intentionally rejects US jurisdiction.
Words mean something.
The amendment does not state: "All persons born or naturalized in the United States are citizens of the United States and of the State wherein they reside."
It instead states:"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."
Even a SCJ should have been able to understand the meaning.

Over the years there have been many FReepers that claim they have provided proof the 14th does indeed provide citizenship for illegals dropped on U.S. soil. Many of us who've claimed it doesn't have been called names like xenophobe, racist, etc.
It's a damned shame we lost many on FR who spoke out vehemently against this invasion (even Rush finally called it that today - about ten years too late) and were banned or got too fed up with the abuse.
BTW, this invasion was small change till Bush got in. He really got it going and his brother wants a chance to get in on the destruction. I now hate the Bushes for what they've done to this country's sovereignty.

He also goes into the fact that congress has the right to define who gets citizenship under article 1,section 8. Congress has no such power. Article 1, section 8 authorizes Congress to establish a uniform rule of "naturalization," which is narrower than citizenship. 14th amendment birthright citizenship is not "naturalization," so Congress's power under Article 1, Section 8 is irrelevant.
