Democratic presidential candidate Martin O'Malley on Friday blasted Texas for denying birth certificates to some U.S.-born children of illegal immigrants without valid identification documents, declaring that citizenship is a human right.
Denying birth certificates to U.S, citizens is not only outrageous, its unconstitutional, the former Maryland governor said in a statement released in English and Spanish.
The 14th amendment of the U.S. Constitution could not be clearer. It states that all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside, he said. The Texas Department of State Health services should cease this discriminatory and unconstitutional practice immediately. Citizenship is a human right.
Mr. O'Malley has attempted to challenge Democratic presidential front-runner Hillary Clinton on immigration, proposing the most sweeping plans for amnesty and expanding rights for illegal immigrants of any candidate.
A group of 19 illegal immigrant parents and their 23 children have filed suit against the Texas Department of State Health Services after officials refused to issue birth certificates the U.S.-born children, citing invalid forms of identification.

People born in Texas DO get birth certificates. They are done by the hospitals.
The illegals filing the suit have no documentation that proves their kids were born in Texas OR the US.
See that very fact changes the whole contect of theargument. It wasn’t about not issuing the birth certificates alone. It was about parents not having any ID to provewho they are so a VALID birth certificate can be issued. Of course, facts don’t matter to the leftists. They just want what thwe want and if they don’t get it expect: a) social media attacks from lefties en masse, b) lawyers, and/or c) political activism.

These US born anchor citizens are legally entitled to their birth certificates and could get them - when they are of legal age, or via a legally-appointed guardian.
The problem here comes with the parents, NOT US Citizens - ILLEGALS, in meeting their valid proof of identity and origin (i.e., the Texas State Department of Vital Records has said a Mexican consular ID is not an original and valid document).
I agree with the DVR. The kids can wait or they can get a guardian who is legal and provides the proper legal documents.

Not originally. “Anchor baby” is a relatively recent concept, and was created out of thin air, much like the “right to privacy” that was interpreted into the Constitution, but, of course, in actuality it isn’t there. They used that fictional Constitutional “right to privacy” to legalize abortion.
It is the words/requirement of ‘and subject to the jurisdiction thereof’ that these wannabe moochers don’t pay any attention. Most of them probably can’t even read and/or understand that phrase let alone have any legal intentions for abiding by such.
Sorry, but the 14th Amendment and Wong Arc make it clear that the parents must have legal US residency for there to be birthright citizenship for children.
Throughout US Law there is the principal that you cannot legally gain from an illegal act. Breaking immigration laws is therefore a reason for both the parents and the child to be denied citizenship........
You have separated the chaff from the grain. Many if not most people like the illegal immigrants have not done such. I suspect they do not because they want to intentionally contaminate the grain.

Nonsense. "Subject to the jurisdiction thereof" eliminates an invader's child's citizenship. These are foreign nationals. Their offspring are subject to Mexican jurisdiction, not American. If the Mexican Ambassador's wife gave birth in a NYC hospital, would anyone ever argue the child was American? Preposterous. All the more preposterous that a pregnant Mexican here ILLEGALLY, who merely spreads her legs and drops a baby a mile across the border has created a new American citizen.
This is where the law is colliding with the law. The parents do not have proper ID (required by law), therefore, no legal document can LEGALLY be turned over. It is ironic that the ID laws can de-rail the whole anchor baby thingy.
