Democratic presidential candidate Martin O'Malley on Friday blasted Texas for denying birth certificates to some U.S.-born children of illegal immigrants without valid identification documents, declaring that citizenship is a human right.
Denying birth certificates to U.S, citizens is not only outrageous, its unconstitutional, the former Maryland governor said in a statement released in English and Spanish.
The 14th amendment of the U.S. Constitution could not be clearer. It states that all persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside, he said. The Texas Department of State Health services should cease this discriminatory and unconstitutional practice immediately. Citizenship is a human right.
Mr. O'Malley has attempted to challenge Democratic presidential front-runner Hillary Clinton on immigration, proposing the most sweeping plans for amnesty and expanding rights for illegal immigrants of any candidate.
A group of 19 illegal immigrant parents and their 23 children have filed suit against the Texas Department of State Health Services after officials refused to issue birth certificates the U.S.-born children, citing invalid forms of identification.

An illegal alien’s offspring is not subject to the jurisdiction of the United States. If everyone born in the US is automatically a citizen, why would they even mention jurisdiction? They could have simply written, “Everyone born in the USA is a citizen!”

Not citizens, not legal, no citizenship-giving birth certificates. Confirm information to their home country for them to issue a birth certificate. End the misuse of the 14th amendment. Good to see Texas taking a step in the right direction on this (even though they may lose in court).
Hey, all these illegal alien parents need to do is fess up on their illegal status, show their real docs, get the birth information, and be deported home. End of story.
Maryland is one of the most corrupt screwed up states I have ever had the misfortune of dealing with. Far worse than even California.

You had to have three documents to prove who you were. That means you couldn’t sign your name as Goldilocks and the Three Bears - darn.
People also don’t understand how a person signs up to get on a county voter list. They seem to think illegal aliens can sign up with no problem. No, they have to provide credible ID AND their names (at least in Texas), go to our state secretary of state’s office, the elections division, to be determined if that person is a citizen of this country. If they aren’t, their name doesn’t go on the official voter list. If they are, the SOS tells the county to put their name on the list as they are a citizen.

Dear heavens. After enduring 8 very long years of this fool, it is painful to see him STILL in the media.
I don’t think he’d come close to winning the D nomination in Maryland, even if no other candidates were on the ballot. Mickey Mouse would finally win!
The 14th wasn’t meant to do this. It needs fixed.
If the kids want to claim dual Mexican/American citizenship, great.
They can go "home" to Mexico.

Sorry, but that doesn’t really hold up well. If you are unsure of the parents identity then the section can be left blank, or filled in as unknown or John/Jane Doe. That’s not an acceptable reason for denying a kid a birth certificate. If there is clear and unambiguous evidence that kid was born here s/he is an American citizen and entitled to a birth certificate.
I don’t like the law, but it is the law. And no state can try to effectively annul someone’s citizenship like that. There is only solution for this...
REPEAL THE BIRTRIGHT CITIZENSHIP CLAUSE!
Section One of Amendment 14 states:
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
If the federal government wants illegal alien’s anchor babies to be citizens then they can pay for the expense to trudge hey federal weasel to go to the hospital and award the birth certificate themselves.
Nothing in the 14th amendment says that states must issue birth certificates, it just states that anyone born here is a citizen. Texas could write a law tomorrow saying it defers to the federal government the responsibility to handle documenting these invaders. The federal sports always rule that the states don’t have any standing on matters of citizenship and immigration so all they have to say is “You’re right Fedzilla, we have no standing regarding immigration and naturalization and we don’t have the capability to process and verify these foreign identification documents to verify identity.”
