Obama and Shrillary aren’t the only ones to “evolve” rather dramatically regarding the federal desecration of marriage on behalf of the radical homosexual agenda. Legal Insurrection recalls testimony by leftist Supreme Court Injustice Elena Kagan during her confirmation hearings. This is so straightforward, you had to know she didn’t mean it: Senator John Cornyn: Do you believe that there is a federal constitutional right to samesex marriage? Kagan: There is no federal constitutional right to same-sex marriage.

She didn’t “evolve”. She lied to get the Republicans to confirm her.

As if it mattered. They'd confirm Satan himself telling the absolute truth about his agenda if they thought it was politically expedient, would avoid negative news coverage, etc.

Thank you for referencing that article QT3.14. Please bear in mind that the following critique is directed at the article and not at you.

FR: Never Accept the Premise of Your Opponent’s Argument

While I appreciate Moonbattery’s blog, Senator Cornyn’s PC, possibly staged question is another example why the ill-conceived 17th Amendment (17A) should never have been ratified. More about 17A shortly.

With all due respect to Senator Cornyn, all that he or any citizen has to do is read the Constitution to verify that the states have never amended the Constitution to expressly protect gay marriage. The same with the so-called “right” to have an abortion.

In fact, regardless that activist justices used the 14th Amendment as their excuse to bluff that gay marriage is a right, they wrongly ignored the following. They ignored that the congressional record shows that John Bingham, the main author of Section 1 of the 14th Amendment, had clarified that the 14th Amendment applies only those rights that the states have amended the constitution to expressly protect to the states.

“Mr. Speaker, this House may safely follow the example of the makers of the Constitution and the builders of the Republic, by passing laws for enforcing all the privileges and immunities of the United States as guaranteed by the amended Constitution and expressly enumerated in the Constitution [emphasis added].” —John Bingham, Congressional Globe, House of Representatives, 42nd Congress, 1st Session. (See lower half of third column.)

And since the states have never amended the Constitution to expressly protect gay marriage, Obama’s puppet justices actually had no enumerated protections for gay marriage to throw at the states.

The Supreme Court had put it this way.

“3. The Constitution was written to be understood by the voters; its words and phrases were used in their normal and ordinary as distinguished from technical meaning; where the intention is clear, there is no room for construction and no excuse for interpolation or addition.” —United States v. Sprague, 1931.

Again, the Constitution is silent about about gay marriage and abortion.

The 17th Amendment needs to disappear, and corrupt senators, activist justices, and a lawless president along with it.
