Mississippi is considering pulling the plug on issuing marriage licenses altogether after the Supreme Court struck down bans on gay marriage Friday morning.
As the state's governor and lieutenant governor condemned the court's decision, state House Judiciary Chairman Andy Gipson began studying ways to prevent gay marriage in Mississippi. Governor Phil Bryant said he would do all he can "to protect and defend the religious freedoms of Mississippi." To Bryant's point of doing "all" the state could do, Gipson, who is a Baptist minister, suggested removing marriage licenses entirely.

If the Feds want to impose a odious edict on a state function, then the state is within its right to just stop doing it.
This is an excellent move. Marriage is a religious institution in which the state should play no role at all. Everything that needs to be done civilly can be handled under contract and probate law.

I haven’t researched this AT ALL ... but doesn’t that affect tax breaks for those that want t get married?
Not my area of expertise but that seems to create a Federal tax problem for couples as the IRS may not consider it “married”.
Also, isn’t there a REAL problem of having a Fed Ct saying that there now must be some avenue of marriage (if for no other reason than the tax issue) and then force Churches to marry gays?
Again, I haven’t researched this issue one iota but the lawyer in me sees a whole lot of potential red flags that could make this even worse for us.

Lo and behold the entire land is filled with pens and phones!
If the state no longer issues marriage licenses then if a resident and spouse move to another state then they’ll have to get married all over again.
Conservatives wanted the government to define marriage. Well, they just did.

Civil marriage is nothing.
Religious marriage is everything.
The left will celebrate this. The end of legal marriage is an awesome victory for the radical left.
So you’d rather have gay government marriage than move it into the private sector where the original intent can be preserved.
I don’t know how this will work out but a private sector end-run wouldn’t hurt my feelings one bit.

And what happens to straight couples who want to get married? Presumably, they will get married in a church without a license. But then what? Will they lose their right to inherit if their spouse dies without a will, to make medical decisions for their incapacitated spouse, or to have custody of their children if the couple splits up?
If all Mississippi is going to do is stop issuing marriage licenses but will continue to grant legal recognition to marriages performed without a license, they will not be able to deny that same recognition to same-sex marriages.
The reason why one state recognizes the marriage of someone married in another state is because of Article IV, Section 1. Take away the marriage license and you take away the Article IV protection where your marriage is concerned.
