AUSTIN, Texas -- "It's a very real possibility" that the state of Texas would file a lawsuit to block President Barack Obama's plan to enact sweeping immigration reforms by executive order, said Texas Governor Rick Perry in a speech at the Republican Governors Association's (RGA) annual meeting in Boca Raton, Florida on Wednesday. Obama is scheduled to unveil his plans in a prime time speech on Thursday evening, to allow millions of illegal immigrants to avoid deportation by what is known as "deferred action," a move that was also strongly opposed by the other Republican Governors at the meeting, leading to immigration dominating the discussions on the first full day of the RGA's event, as reported by the AP. Other governors in attendance, including Gov. Scott Walker (R-Wisconsin) and Gov. Bobby Jindal (R-Louisiana), agreed with Perry that a lawsuit would be an appropriate response to Obama's executive order.

Perry's successor, Governor-elect Greg Abbott, took a similarly critical stance against the President's plan in an appearance on Fox News Channel's The O'Reilly Factor, saying that Obama did not have the legal authority to waive immigration laws for millions of people at once.

As Breitbart Texas' Kristin Tate reported, Abbott has vowed to file suit in federal court "as soon as possible" after Obama signs his executive order. "We are prepared to assert legal action against the President because we believe that what the President is doing is completely unconstitutional," said Abbott. "He has a legal obligation to enforce the laws, [and] immigration is assigned by the Constitution to the United States Congress to determine, not the President."

And I am confident the lawsuits can put the kibosh on Obama's amnesty lawlessness, why? Because either a Temporary Federal Restraining Order or a Preliminary Federal Injunction can be quickly obtained while a lawsuit proceeds. And the temporary court order can last at least a year and possibly two, enough time for a Conservative Candidate to mount a campaign for President based on lawless amnesty.
But there is a 'glitch' and the Obama people may have deliberately caused it so that the lawsuits remain on hold. Here I describe what this 'glitch' could be.

Let's repeat the operative phrase above in CAPS:
"...AFTER OBAMA SIGNS HIS EXECUTIVE ORDER."
Where is this EO?
There is a summary on the White House Website but there is no signed order that I have been able to find. If any Freeper can find it, then one of the concerns raised in this thread goes away.
Without the signed EO for Executive Amnesty, the states may find it difficult to proceed in Court.
There are rumors that Obama is not planning on signing an EO, just in directing his departments by informal communications on what they must do. That includes issuing ID CARDS which also serve to trigger issuance of work permits, SSNs and illegal registrations to vote. The CARDS are the lynchpin to the whole scheme.
It is probable that Obama's people know that a signed EO can be used as the basis for states to get into court to stop the CARDS.
So it is possible the Obama people are tying up court action by not issuing the officially signed EO.
But there is a way to get around having to use the EO attached to the filing of a motion.
The states can proceed because there is a solicitation for an RFP to manufacture up to 34 million CARDS for "future immigration reform initiatives" and this solicitation is in fact illegal as there is no law or appropriation that authorizes its release.
In other words, the states file to stop the solicitation for the CARDS. Without the cards, Obama is stopped cold. If any contractor tries to make the cards and there is a federal court order that stops the cards, then the contractor and the federal officials involved are subject to arrest on charges of contempt of court.
Obama need people to carry out his directives. If these people balk because they know they will be going to jail, then the CARDS do not get made. do not get issued and Obama's plan is left as strings of words in the air.

Abbott can file immediately as Texas’ Attorney General before he takes over as Governor. As Texas AG or Governor, he has standing to sue.
But where is the EO? What if Obama is not going to sign one and is going to follow his plan with verbal and informal written instructions?
I could not find it yet.
It is not at WikiDocs, which has all EO in history, nor at the Whitehouse EO page, at least as of last night.

Then I don’t see how Obama prevails.
There has to be some form of legitimate process, even if just to claim it’s legitimate.
The game is in the CARDS, the ID Cards that trigger all the rest including illegal voter registrations.
The CARDS are the lynchpin of the whole process.
Yesterday it was reported that General Dynamics was given the federal contract to make the CARDS.
Abbott is saying he files as soon as the EO is signed. What he needs to do now is file without the EO and file against the solicitation of the CARDS! Shut General Dynamics down on the CARD manufacturing and shut down any and all federal contractors that are involved in the CARDS.
That’s interesting. I certainly wouldn’t put it past him to come up with yet another way of kicking sand in our faces and frustrating the will of the people. He’s vicious and a very sneaky, devious person, and his “advisers” are likewise.
There’s a way you could actually defund.
I like the idea.
As much as I would like to see the GOP we put in power ride to the rescue here, over they past few years I have come to think of them as the remaining female die in beer dive at 1:00 AM (back when I wore a much younger dices’ white and black dots): If I keep my standards really low, I’m much less likely to be disappointed.
My Gee Oh Pee beer-goggles see the new majority critters bushing-out their fur to appear larger, doing a lot of harrumphing and fist-shaking, and then looking around, sighing and finally going home because it’s Friday as well as way too close to the holidays.
And it’s just a lot of bother, much like defending conservative groups from a predatory IRS, particularly since quite a few of their number think amnesty is great, but as pragmatists they know the country thinks “comprehensive immigration reform” is just a big wad of boiled spinach.
So get ready for a lot of Disasterpiece Theater. Maybe they’ll surprise us ... but I’ll keep my eye on the hefty but hot heifer over in the corner slamming back tequila shots.

If you have a conservative rep in Congress, please call their office and tell them of the EO head fake and that any state lawsuits should be directed against the solicitation (which already exists) for the CARDS.
Well, if that is the Zero's plan, it sounds pretty weak. Essentially, what he would be doing is saying to his minions, "Hey, I want you to break the law or be negligent in your duties, and oh by the way, this is unofficial and your ass is the one on the line if something bad comes of it."
Only an idiot (and I admit there are many out there) would take him up on that offer.
If not signing anything official was his "plan", then the only purpose in his announcing anything is pandering and stirring up the masses, which is what a community organizer does.
What’s to stop Obama’s funding officials from contracting with a company to manufacture the CARDS? The CARDS are key.
Yesterday it was published that General Dynamics will be getting the contract to manufacture the CARDS. Is GD worried about an EO? No.
Who should be worried about an EO? No one. Why? Because there are already open purchase orders for card manufacturing. Obama’s people need only augment the capacity to handle tens of millions of new CARDS.
There is no court order YET barring Obama’s people from engaging in cranking up the supply of CARDS.
Abbott needs to file against CARD manufacturing above and beyond what Congress has authorized. If he waits for the EO, he may be unaware that he is being tricked and that no EO will be forthcoming while in the background the manufacture of CARDS is getting cranked up to more than 1000%.
I think we are in violent agreement. My point was that for a contract to be let, someone has to authorize the spending. And that spending must be approved or that someone can go to jail. Not many contracting officers I know are going to stick their !@#%$ out for Obozo to throw them under the bus.

and then page 28 under Statement of Work, last sentence of Section 4 SCOPE:
“In addition, the Contractor shall demonstrate the capability to support potential “surge” in PRC and EAD card demand for up to 9M cards during the initial period of performance to support possible future immigration reform initiative requirements.”
Get that? Surge! FUTURE IMMIGRATION REFORM INITIATIVE REQUIREMENTS!
Now it must happen that this SOLICITATION is SQUASHED and that no amount of CARDS above and beyond what Congress has authorized be allowed to be made. If this effort to procure 34 millions CARDS is stopped, Obama’s plan fails.
Now who is lining up for the contract to do this? General Dynamics.

They know damn well how many cards they’re going to need, and it sure isn’t 5 million.
Looks like my prediction of 25 to 40 million was a lot more accurate than their 5 million.
Admittedly 25-40 million is a big spread, but this is a very difficult number to quantify. And after all, that’s just what they wanted. They wanted to pass this off as a mere 5 million to ease concerns.
I wonder how many Americans actually believed 5 million.

Part of the prosecution of this war is finances, supplies and provisions.
We need the Texas Governor to shut down the CARDS because the CARDS are the weapons that lead to work permits, SSNs, welfare and Obamacare benefits and....AND .... ILLEGAL VOTER REGISTRATIONS.
