But Abbott is saying that he will file “as soon as possible” after Obama signs his executive order.

Abbott can file immediately as Texas’ Attorney General before he takes over as Governor. As Texas AG or Governor, he has standing to sue.

But where is the EO? What if Obama is not going to sign one and is going to follow his plan with verbal and informal written instructions?

Then I don’t see how Obama prevails.

There has to be some form of legitimate process, even if just to claim it’s legitimate.

That’s interesting. I certainly wouldn’t put it past him to come up with yet another way of kicking sand in our faces and frustrating the will of the people. He’s vicious and a very sneaky, devious person, and his “advisers” are likewise.
