"They Just Want The Money!" The IRS Can Now Seize Accounts On Suspicion Alone

“How can this happen?” Ms. Hinders said in a recent interview. “Who takes your money before they prove that you’ve done anything wrong with it?”

The federal government does.

* * *

The topic of civil asset forfeiture has been high on our agenda recently as federal 'agents' discover how to steal Americans' hard-earned cash with zero repurcussions , and decide unilaterally how much cash a 'common man' is allowed to carry; but as The NY Times reports, the escalation to The IRS brings a whole new world of possibilities with regard asset confiscation based on no actual crime being proved...

As The NY Times reports,

For almost 40 years, Carole Hinders has dished out Mexican specialties at her modest cash-only restaurant. For just as long, she deposited the earnings at a small bank branch a block away - until last year, when two tax agents knocked on her door and informed her that they had seized her checking account, almost $33,000.

The Internal Revenue Service agents did not accuse Ms. Hinders of money laundering or cheating on her taxes — in fact, she has not been charged with any crime. Instead, the money was seized solely because she had deposited less than $10,000 at a time, which they viewed as an attempt to avoid triggering a required government report.

Her money was seized under an increasingly controversial area of law known as civil asset forfeiture, which allows law enforcement agents to take property they suspect of being tied to crime even if no criminal charges are filed. Law enforcement agencies get to keep a share of whatever is forfeited.

Critics say this incentive has led to the creation of a law enforcement dragnet, with more than 100 multiagency task forces combing

This article is form ZeroHedge. It’s about as reliable as Debka.

I read it in the Sacramento Bee last week.

No, this article is FROM ZeroHedge. What it is attempting to expose IS REAL, and happens EVERY DAY!

That you choose to ignore the reality of unlawful behaviour by those you pay for is your problem. May you never have to deal with the leviathan you seem to empower.

Thus is the NKVD reborn, here in the US.

The Great American Experiment is dead, killed by fascist wannabes.

So the IRS is just now catching up with the rest of law enforcement.

… was seized solely because she had deposited less than $10,000 at a time …

This was suspicious? It was from a small Mexican restaurant, what did they expect?
Several years ago my car loan was paid off. It was an automatic deduction from a credit union and the deposit was an automatic deduction from my pay. I closed the account and took the balance of the savings account in cash, about 22 $100 bills. I started thinking of the forfeiture actions on the way home. I drove very carefully, not wanting to be stopped and searched. $2200 was more than the average person would carry.

If you have the receipt on your person from the local bank, I wouldn't think it would be an issue. You were probably more at risk at being robbed.

The receipt would be good in court if it came to a court case. An LEO could easily ignore it.

And most “Americans” don’t care because one way or another they think they are getting a cut of the stolen money. What’s the difference between income taxes and asset seizure. Only technical.

Maybe in Hicksville, USA. If I were going to travel with a couple grand, I'd get travelers checks..

Shush. Theirs is is a noble endeavor as they take us to hell with their good intentions. Do not criticize the Free Republic Drug Warriors (Armchair Division).

The IRS has been doing this sort of thing for decades. They’re just emboldened by a cowardly and increasingly looter Administration and Congress.

Actions like this will become more and more ubiquitous as the US economy spirals down the toilet.

The Fedmonster will demand to be “fed”,
and they’ll use all force at their disposal to keep it fed.

Remember that the gov’t has long past the point of being legitimate, governing at the consent of the governed.
They now govern at gunpoint only, but still feel the need to maintain that facade of legitimacy.

The SHTF when they decide they don’t need to any more.

The Institute for Justice is fighting this on a national scale, from a Texas town that essentially stopped anyone from out of town and seized all cash on the excuse it was drug money to Philadelphia having an office that pretty much takes the houses of anyone associated even remotely with a crime (grandson sells dope on grandma’s porch, they try to take her house).

> There are two systems of law in America, criminal and civil. The Seventh amendment flatly states that the right to a Jury trial exists when the value in controversy exceeded $20 — assuming all these are indeed in excess of $20, does this not mean that the IRS is violating the 7th Amendment? (And doesn't that also mean that 18USC242 and 241 apply?)

They get around this by SUING THE MONEY or PROPERTY, not you. Look in the publication of public record where they are "supposed" to publish the actions. You will see these "State of California v. $10,256" cases. I saw these on day when I was bored and started reading the legal ads. There were dozens of them! You'd also see things like "State of California v. 2005 Honda Accord" and "State of California v. XYZ 24 foot fishing boat" There'd be some description of where it was seized and a show cause for someone to appear, but they sue asset, not a person. The asset and money have no rights.

Hm, then does it work the other way?
Citizen X v. Federal Building on Main St

Somehow I think they'd trip all over themselves saying you can't do that!, Illegitimate!, and Foul! if someone tried.
(Hell, I bet the judge would throw it out, on standing, and then declare that such created a damage to the honor and dignity of the State, thus allowing them to [counter-]sue the person too.)

CWII Spark — Fungi: So why did the founding fathers rebel? To have this? This is not a “law,” it is pure anarchy. They (IRS) can seize anything they want, at anytime, with no due process? Wake up America, we are a heartbeat away from utter lawlessness—we are already there, the trigger has yet to be pulled by the IRS.

This is real. The source doesn't matter. It actually comes from many sources anyways.

Stop with the attack on the messenger and deal with the matter at hand.

I don't think there will ever be a "trigger pull" by the IRS. That would snap too many people's attention to them. Instead, it will be a slow, incremental encroachment, as we've seen these last few decades. By the time anyone realizes we're screwed and want to take action, it'll be entirely too late.
