Texas Republican Sen. Cruz eligible to be president should he decide to run
Fox News ^ | May 15, 2013 | Fox News Staff

Texas Republican Sen. Ted Cruz was born in Canada but is qualified to become president should he mount a campaign in 2016 or beyond.

Cruz was born in Calgary, and his father is from Cuba. But the Republican senator’s mother is from the first state of Delaware, which appears to settle the issue.

Government officials didn’t exactly have to scramble for the information amid speculation the firebrand freshman senator was contemplating a presidential run and might be ineligible, considering similar questions about President Obama’s birth prompted the Congressional Research Office to compile a 2009 report to try to resolve the issue.

The 14-page report by the non-partisan office’s legislative attorney Jack Maskell essentially states the Constitution sets out three eligibility requirements to be president: one must be at least 35, a resident within the United States for 14 years and a “natural born citizen.”

The report states "the weight of scholarly legal and historical opinion appears to support the notion that 'natural born citizen' means one who is entitled under the Constitution or laws of the United States to U.S. citizenship 'at birth' or 'by birth,' including … those born abroad of one citizen parent who has met U.S. residency requirements."

However, Maskell points out in an expanded, Nov. 2011 memorandum “there is no Supreme Court case which has ruled specifically on the presidential eligibility requirements, although several cases have addressed the term ‘natural born’ citizen. And this clause has been the subject of several legal and historical treatises over the years, as well as more recent litigation.”

Cruz has excited the Republican Party’s conservative base during his first five months in the Senate – while annoying moderates – by opposing everything from Obama Cabinet nominations to the bipartisan Senate immigration bill.

Cruz for TX Governor?

No, that's Greg Abbott's next job :)

Cruz is doing a fine job where he is, until he runs for Prez of the USA.

Why do people rush to the latest golly, gee wiz, new kid on the block, Conservative and promote push for a Presidential run? Are we that surfeit of leaders?

Sen. Cruz is a good lawyer, knows the law, is an American Patriot, and knows he isn’t eligible under Article II. Same as Barack Obama.....pResident asterisk.

Get a life folks! Sen. Cruz can best serve the nation that he loves right where he is....in the Senate. Ne seems to be doing a bang up job since joining it!

Actually, Fox did make the ruling themselves. This is supposedly a news story. Yet the only facts cited to support the headline are from the Congressional Research Office from 2009 and 2011. No one is quoted saying that Cruz is eligible.

"Cruz has excited the Republican Party’s conservative base during his first five months in the Senate..."

I'm encouraged by Senator Cruz, but he's far, far too new at this point to be considered for president. Plus, the man is a senator, not a governor. Do we have any evidence that he can actually lead? I think that remains to be seen, but I do give him high marks on ideology.

Don’t you get it. Republicans have to support someone who isn’t a natural born citizen.

I mean, it’s too hard to find a conservative who was actually born in America.

Thank you. Some sanity here. Some people say that “if it’s good enough for the democrats, it’s good enough for us”. No, no, it’s not.

lots of ignert FReepers here this morning. Ted was not born here AND his father was not a US cit.(before Ted’s birth?).

I know that part of the constitution. I will be Teds best supporter for Senator or Governor but his worst enemy if
he runs for prez. If he is not qualified - we still keep
going down the tubes as a country. All you CruzBots need
to give it a rest here on FR.

I would love nothing more than for President Cruz to appoint Sarah Palin to be Chief Justice of the Supreme Court.

Just the opposite - unless the court rules in favor, then it’s clear that he’s NOT eligible. Nice try though....

Fox has ALWAYS been an Obama supporter? What Fox network are you watching. I want you to prove your statement with something other than out-of-context, miscellaneous statements and your opinion of what constitutes Obama support. I want to see documentation—both printed and footage will be fine. I sometimes think that Freepers are crazy when they make off-the-wall statements like this.

I really wish that they would make the rules that not only does the President be born in the United States but EACH of the parents and grandparents must be to. Three generations of family members born in America should not be too difficult to ask especially since only 45 people have been President. I don’t want a President who was not born in America.

“Actually, Fox did make the ruling themselves.”

I was speaking of the actual report, not what Fox says:

“The report states “the weight of scholarly legal and historical opinion appears to support the notion that ‘natural born citizen’ means one who is entitled under the Constitution or laws of the United States to U.S. citizenship ‘at birth’ or ‘by birth,’ including … those born abroad of one citizen parent who has met U.S. residency requirements.””

We know his Social Security card is a fake.

How did people get his Social Security number? That is pretty scary that people can get a person’ social security number so easily. I hope mine is not that easily to find. No wonder Identity Theft is so rampant if people can even find the President’s Social Security number.
