Texas Republican Sen. Cruz eligible to be president should he decide to run

Texas Republican Sen. Ted Cruz was born in Canada but is qualified to become president should he mount a campaign in 2016 or beyond.

Cruz was born in Calgary, and his father is from Cuba. But the Republican senator’s mother is from the first state of Delaware, which appears to settle the issue.

Government officials didn’t exactly have to scramble for the information amid speculation the firebrand freshman senator was contemplating a presidential run and might be ineligible, considering similar questions about President Obama’s birth prompted the Congressional Research Office to compile a 2009 report to try to resolve the issue.

The 14-page report by the non-partisan office’s legislative attorney Jack Maskell essentially states the Constitution sets out three eligibility requirements to be president: one must be at least 35, a resident within the United States for 14 years and a “natural born citizen.”

The report states "the weight of scholarly legal and historical opinion appears to support the notion that 'natural born citizen' means one who is entitled under the Constitution or laws of the United States to U.S. citizenship 'at birth' or 'by birth,' including … those born abroad of one citizen parent who has met U.S. residency requirements."

However, Maskell points out in an expanded, Nov. 2011 memorandum “there is no Supreme Court case which has ruled specifically on the presidential eligibility requirements, although several cases have addressed the term ‘natural born’ citizen. And this clause has been the subject of several legal and historical treatises over the years, as well as more recent litigation.”

Cruz has excited the Republican Party’s conservative base during his first five months in the Senate – while annoying moderates – by opposing everything from Obama Cabinet nominations to the bipartisan Senate immigration bill.

The 42-year-old Cruz has yet to publicly announce his intentions, but in front of a microphone he talks mostly about big-picture national issues, with most of the presidential buzz coming from supporters.

The Democrats will demand a special investigation into the circumstances of his birth. But the media will not call them “birthers”. In fact, the MSM will demand that the Constitution be adhered to...and Cruz be disqualified.

Wait and see.

I love Cruz, but it’s WAY to soon for him to run for president.

Maybe in 2020, but for now, I like him right where he is.

We don’t need to lose another great conservative leader of the future like we did Palin because they are pushed to run too soon.

Fox again gets it wrong on Eligibility.... of course they have always been Obama Supporter and attacked Birthers on the Eligibility.

There is a way to make Cruz eligible.... but the Obama Supporters need to back off and help Birthers get Obama’s Birth Certificate.

I would like to see Cruz become President....but the same PhonyCon Obama Supporter Anti-Birthers will be the ones trying to fight the Cruz nomination based on Eligibility..... you can bet on that

As usual this thread will promote the back and forth with lots of cites as to what the constitution/laws/statutes say or mean. But in reality it matters not a whit what is said or cited here. The only thing that matters is what nine black robed members of the SCOTUS proclaim. If and when they do make a proclamation then we’ll know. Otherwise let him throw his hat in the mix if he so chooses.

That is true.

But truth be known, Palin is perhaps the strongest Republican at the point in time, if she chooses to run in 2016.

Granted that is not a sure thing, but I would give it a better than 50%.

Not that I know anything more than anyone else, but in my opinion Palin’s potential has developed just fine, thank you.

Pretty much, other than not running last time, optimal.

I love Palin, and would vote for her in a second for president.

But you have to admit the hatchet job they did on here was pretty effective.

Of course there was a time before the 2008 election when Hillary was the most despised woman in politics, and now she is the most popular person in politics. So it is possible to redeem oneself.

The report is correct. The problem with Hussein is, if he was born in Kenya and his mother qualified by US laws in effect at that time about residence, but she didn't register the baby as American, then someone faked a Hawaiian birth certificate and he is still a citizen of Kenya.

We know his Social Security card is a fake. Hussein himself is a fake. His whole life is a fake.
