Just announced on Rush. On the heels of today's SCOTUS decision regarding Arizona's border protection law, Napalitano (Obama) has just notified Arizona that the federal government/ICE/DHS has been ordered not to cooperate with AZ regarding the reporting of illegals stopped in AZ.

Here’s the thing about that - the states have never enforced Federal laws and the Federal authorities have never enforced state laws.

A state arresting someone who has an arrest warrant on the Federal level - is simply handing them over to the Federal authorities and nothing more than that. past that point, it’s the Federal authorities who enforce their Federal laws.

And the Federal authorities arresting someone who has a warrant for arrest from the state - is nothing more than simply handing the person over to the state authorities. And past that point it’s only the state authorities who enforce their own laws.

The bottom line is that the states have never enforced Federal laws and the Federal authorities have never enforced state laws.

I believe his O’liness is just warming up. He has crossed the line, if not officially then unofficially, and now he can only move “forward”
I bet he pardons some of the scum of the earth in November regardless if he is re-elected.

I would consider making an arrest part of enforcing the law. What I’m saying is the state should tell the feds they won’t be arresting anyone on felony warrants if the government doesn’t want the state to arrest illegal aliens.

The local and state cops don’t enforce Federal laws. At the most, all they do is arrest someone if there is an arrest warrant, or arrest someone if they’ve violated a state law - and then the Federal authorities may also jump in on it, if there is a Federal law violated.

The states enforce their own laws and the Federal authorities enforce their own laws. They each don’t enforce the “others’ laws”.

I suppose AZ could just keep them in detention forever and use them as slaves for the State, such as for building roads.

Or a big ol' wall.

Yours is the best suggestion I've heard so far.

I figure instead of spending our taxpayer money on walls let’s make the illegal aliens get the work and free meals they were looking for and save us taxpayers some money.

The Nation also has a rogue Supreme Court and a rogue/belly up Congress. How did this Nation come to this point? It had the roots in the ‘goody-feeling’ idea that the USA was so dedicated to the Founder’s intentions that no numbers of immigrants from anywhere for any reason could not/should not be accommodated. Somewhere in all of this was lost that the USA was supposed to be a Nation of people dedicated to the Founder’s intentions and not a modern day tower of Babel. I would bet that the men killed in the wars past and present would also wonder about what citizenship means today. It will be interesting to watch all the 4th of July celebrations.

So the Federal government refuses to enforce its own laws? And Arizona can’t report illegals, even though the Supreme Court says it can?

I wouldn’t consider that any part of effectively enforcing the law, simply because a lot of people are arrested and simply let go. It happens all the time. The law isn’t enforced (at least the way I look at it) unless a case is carried through in a court of law and a person is convicted. Then it’s “enforced”.

“Arrest” is a very low bar and just about anyone can be arrested for almost anything. And so it doesn’t mean much. It means something - in terms of “enforcement” if a person is CONVICTED of a crime and there has been “due process” given and you get a guilty verdict. Then you’re talking about enforcement.

Why can’t some citizens of this country bring a suit against the Federal government for refusing to enforce Federal law? By what legal authority can it do this?

Obama is acting more like a dictator every day.

I’m not surprised that the U. S. struck down the attempts at creating state laws that already had federal versions on the books.

I am heartened to see that stops can still be made. When stops are made, identification is always required. Those not having identification can naturally be asked to provide documents. If they can’t, they’re up a creek without a paddle.

If I were the chief state law enforcement officer, I’d order my people to take those illegals to the border and drop them off and watch them walk across.

If they’re from another nation, I’d incarcerate them until the Feds agreed to pick them up. I would not turn them over unless the Feds agreed to deport them.

Well, you’re right. Apparently the prevailing members of the SC hold that the Feds have a right to enforce the border but not a duty. Brilliant.
