Update: Breaking from Hawaii: No More Long-Form Birth Certificates!

Miki Booth has just reported via telephone to The Post & Email that a man born and currently residing in Hawaii went to the Department of Health this morning and requested a copy of his long-form birth certificate. He was refused, told that it was no longer available and that all he could obtain is the short-form document.

The man had obtained his short-form “Certificate of Live Birth” several weeks ago and reported to Miki that the request form had had two different boxes which could be checked: one indicating that the short-form was being requested and the other that the long-form was desired.

Today, the man reported that the form has been changed such that that choice is no longer available.

Therefore, when Dr. Chiyome Fukino spoke with MSNBC on Monday morning, she apparently was not lying when she said that long-form birth certificates are no longer available.

But why was that change made? Who ordered the change in policy? Was it made because Donald Trump has demanded that Obama release his original, detailed birth certificate to support his claim of a Hawaii birth?

The witness who accompanied the gentleman has a daughter who obtained a copy of her long-form birth certificate last month. The document was provided to Miki Booth, who supplied it to The Post & Email here.

What is ironic is that there are a lot of people like me who would never have shown interest in this topic if there weren’t such bizarre antics on the other side. I can contact the state in which I was born and “Hey Presto” - in relatively no time I have a certified copy in my hands. So now more people are wondering “What the heck is the big deal? So produce the silly thing!”

Well, this guy’s screwed if he ever moves to Texas. He’ll never be able to obtain a legal driver’s license without his LFBC.

You know, that’s funny. My kid was born in Texas and when I wrote to the state’s vital records office to request a birth certificate (and that is what I asked for), they sent me a short form that doesn’t even have as much information as the Hawaii COLB. It was accepted to get a US passport. But you say this document that was issued by the state of Texas won’t be accepted by the state of Texas to get a driver’s license?

The UIPA Booklet (which can be seen in full at http://hawaii.gov/oip/UIPA%20Manual%205aug08.pdf ; this is on page 26, describing Hawaii’s UIPA law (which HI tried to gut with the “vexatious requester bill” but didn’t end up passing that version of the bill):

An agency MUST (emphasis mine) provide an individual access to his or her personal record within 10 working days after receiving a request unless an exception under part III allows the agency to withhold the record from that requester.

The agency may extend its response period for an additional
20 working days if, within the initial 10 day period, the agency provides the individual with a written explanation of “unusual circumstances” causing the delay.

The Exemptions from Disclosure (§92F-22)
The personal records section of the UIPA contains its own set of exceptions, which differ from those for general government records requests.
Generally, these exceptions protect:
(1) Criminal law enforcement agency records;
(2) Confidential source records;
(3) Government exam records;
(4) Investigative materials; and
(5) Records protected by law

The actual UIPA law can be found at http://hawaii.gov/oip/uipa.html . For personal records it’s Part III that applies. 92F-28 says:

“Nothing in this part shall be construed to permit or require an agency to withhold or deny access to a personal record, or any information in a personal record:

(1) When the agency is ordered to produce, disclose, or allow access to the record or information in the record, or when discovery of such record or information is allowed by prevailing rules of discovery or by subpoena, in any judicial or administrative proceeding; or

(2) Where any statute, administrative rules, rule of court, judicial decision, or other law authorizes or allows an individual to gain access to a personal record or to any information in a personal record or requires that the individual be given such access. [L 1988, c 262, pt of §1]”

So under UIPA, if the Administrative Rules ALLOWS an individual to gain access then nothing in UIPA allows the HDOH Director (for instance) to deny access to a personal record.

This new refusal to disclose copies of long-form BC’s is a clear violation of UIPA.

Furthermore, the fact that Fukino was aware of this change when she was interviewed suggests to me that she was kept in the loop by the current HDOH Director before Isikoff called Fukino for the interview. I imagine the current director also told her what the forged long-form looks like so she would know how to respond to Isikoff.

This is a breach of their Open Records Law (UIPA), but keep in mind that they already tried to gut UIPA specifically in response to people asking about Obama’s records. And they have been breaking laws all along, some of which is documented on my blog at www.butterdezillion.wordpress.com . There’s much more that I didn’t even bother to post on.

So the trappings have always been there, which is why a lot of us who have been involved in this don’t just roll over and die when some politician or reporter lectures us about how stupid we are and how nothing will ever be good enough for us, etc ad nauseum. It’s just that now the trappings are becoming more widely known.

Did everyone born in Hawaii in 1961 at the hospital it's claimed Obama was born at get a LFCB?

If they did, Obama should have one.

Does any other state refuse to provide copies of LFCBs from their archives? If not, why is Hawaii doing it, and why now?

I went through hell to get my Texas driver's license. I had every identifying document except a copy of my California LFBC, but that was the only one the Dept of Transportation would accept.

At the time (2009?), I was told that a new state law had gone into effect, and that the LFBC was now required to establish identity.

I didn't even know that Texas issued short form birth certificates. I have no idea whether they'll accept their own COLB as proof.

Yes, I kind of agree. Part of me thinks Trump really wants to run for president, but part of me says that he is sick of this Obama nonsense (even though he supported him once upon a time) and wants to do his own made-for-TV expose.

The other thing is that Trump is safe if he’s a Presidential candidate. I think he’s safe from lawsuits, and I also think that even Obama wouldn’t be brazen enough to take out a contending presidential candidate. I hope, at any rate...

Apostrophe denotes possession, not plural.

It also denotes a contraction, such as in the words didn't, or it's.

Thanks for pointing it out. Apostrophe abuse is becoming widespread.

*A certified birth certificate has a registrar’s raised, embossed, impressed or multicolored seal, registrar’s signature, and the date the certificate was filed with the registrar’s office, which must be within 1 year of your birth. Please note, some short (abstract) versions of birth certificates may not be acceptable for passport purposes.

Beginning April 1, 2011, all birth certificates must also include the full names of the applicant’s parent(s). For more information, please see New Requirement for all U.S. Birth Certificates.

I may be mistaken but the short form may not get you a drivers license in some states.

I know from personal experience that a short form won't get you a Texas driver's license.

My COLB was used to get my passport.

Check your COLB. Does it have the delivering doctor's signature, witness signature, hospital of birth, time of birth, weight, length, mother and father's race, etc?

If so, you've got a long form birth certificate.
