WASHINGTON With much of his legislative agenda stalled in Congress, President Obama and his team are preparing an array of actions using his executive power to advance energy, environmental, fiscal and other domestic policy priorities.
Mr. Obama has not given up hope of progress on Capitol Hill, aides said, and has scheduled a session with Republican leaders on health care later this month. But in the aftermath of a special election in Massachusetts that cost Democrats unilateral control of the Senate, the White House is getting ready to act on its own in the face of partisan gridlock heading into the midterm campaign.
We are reviewing a list of presidential executive orders and directives to get the job done across a front of issues, said Rahm Emanuel, the White House chief of staff.
Any president has vast authority to influence policy even without legislation, through executive orders, agency rule-making and administrative fiat. And Mr. Obamas success this week in pressuring the Senate to confirm 27 nominations by threatening to use his recess appointment power demonstrated that executive authority can also be leveraged to force action by Congress.
Mr. Obama has already decided to create a bipartisan budget commission under his own authority after Congress refused to do so. His administration has signaled that it plans to use its discretion to soften enforcement of the ban on openly gay men and lesbians serving in the military, even as Congress considers repealing the law. And the Environmental Protection Agency is moving forward with possible regulations on heat-trapping gases blamed for climate change, while a bill to cap such emissions languishes in the Senate.
In an effort to demonstrate forward momentum, the White House is also drawing more attention to the sorts of actions taken regularly by cabinet departments without much fanfare.

It is quite common for US Presidents to issue executive orders that instruct federal agencies to promulgate administrative regulations in order to circumvent the legislative process in the US Congress altogether, though, as alluded to above, this can violate the US Constitution in a number of ways.
US Presidents are quite aware that US congressional politics can defeat or otherwise prevent the passage of legislation presidents deem politically important. In this regard, US Presidents have issued executive orders calling upon federal agencies, such as the US Environmental Protection Agency (EPA) and the United States Department of Energy (DOE), to issue administrative regulations where the political process of adopting congressional legislation necessary to implement multilateral environmental regulatory treaty obligations a president wishes for the US to assume would prevent US ratification of/accession to that treaty.
US Presidents, furthermore, may use an executive order or a presidential memorandum to ensure that federal courts abide by international tribunal rulings interpreting the provisions of an international treaty.
Perhaps, President Obama has in mind to pursue one or both of these uses of executive orders to ensure the US abides by any successor agreement to the Kyoto Protocol to the United Nations Framework Convention on Climate Change (UNFCCC) and by the United Nations Convention on the Law of the Sea, even though the US has remained a non-party to both treaties for political reasons.

After a bipartisan furor in Congress last year, Mr. Obama stopped issuing such signing statements, but aides said last month that he still reserves the right to ignore sections of bills he considers unconstitutional if objections have been lodged previously by the executive branch.
When he signs the first one, we all need to meet in D.C. with the torches and pitchforks and Inform him, we will no longer tolerate his thuggery!

Liberty is at stake and the clock is ticking. We don’t have a constitutional government. The ONLY thing preventing Obama from doing what he wants is the fact that we have an armed populace.
The Japanese in WW2 were correct to say they would never invade the USA because there would be a gun behind every blade of grass. If Obama did what he wanted to, those 2 million that marched on DC in the Tea Party march will swell to about 10 million overnight, and those occupying the halls of congress and the White House would suddenly find themselves faced with a very large and angry populace on their doorsteps. Even HE fears that.
That is the ONLY thing staying their hands now. IMHO.
People don’t get just how serious this is. This is an issue that MUST be decided one way or another. As far as I can see historically, that means Obambi is out on his ass, or in Prison Orange with Nancy. Best thing for the bastard to do is resign and get a pardon from Biden. But Bambi IS NOT that smart and his damned ego is too big, so to the abyss we go.

Thanks for the info and the link. I didn’t realize how vague the rule is. Recess appointments I can deal with, John Bolton was a great asset. Using it to implement laws congress, which is our voice, refuses to pass has to be questionable.

Doubtful it would help. First, they would have to write a law to counteract the executive order, then get it passed through both houses of Congress then get the President's signature or override his veto. Since the Democrats will either continue to have majorities in both chambers or, at the very least, be able to sustain a veto override, it wouldn't be worth the effort unless the EO was so offensive that even a large contingent of Democrats believed it went too far.
LOL! Who knew that Clintigula would be so soon replaced by Obamageddon? And the beast was not hillary with her cankles and cloven hooves, but a short wispy sulpher eater named Rahm??
