A California judge today tentatively scheduled a trial for Jan. 26, 2010, for a case that challenges Barack Obama's eligibility to be president based on questions over his qualifications under the requirements of the U.S. Constitution.
If the case actually goes to arguments before U.S. District Judge David Carter, it will be the first time the merits of the dispute have been argued in open court, according to one of the attorneys working on the issue.
In a highly anticipated hearing today before Carter, several motions were heard, including a resolution to long-standing questions about whether attorney Orly Taitz properly served notice on the defendants, which she had.
In a second ruling, Carter ordered that attorney Gary Kreep of the United States Justice Foundation can be added to the case to represent defendants Wiley Drake and Markham Robinson, who had been removed by an earlier court order. Drake, the vice presidential candidate for the American Independent Party, and Robinson, the party's chairman, were restored as plaintiffs.
But the judge did not immediately rule on Taitz' motion to be granted discovery – that is the right to see the president's still-concealed records. Nor did Carter rule immediately on a motion to dismiss the case, submitted by the U.S. government, following discussion over Taitz' challenge to the work of a magistrate in the case.

Just wondering:
When judge Carter signed up to join the marines, did he have to provide a long form birth certificate and/or high school and college records?
When judge Carter was appointed a judge, did he have to provide his marine records, his long form birth certificate, and his college records before he was officially appointed to be a judge?

Let’s hope we can do that. I’m afraid my feelings on the subject are rather gloomy.
Some people think that Mark Penn, who told Hillary not to do the caucuses, was an Obama plant the entire time.

Seriously, again, excepting this judge on your recommendation, I’m simply expressing my (yes, cynical) disdain for the general state of affairs. I’ve sat by (by my own admission, way too long) watching this crap HAPPEN to my Country. I guess its just the frustration bubbling up. No disrespect intended. Being a natural born citizen is not a requirement to be a federal judge.
Did you know that there is no requirement to be a lawyer to become a federal judge in a federal court at any level, including the U.S. Supreme Court?
In fact there is only one position mentioned in the constitution that requires a legal question, and even that requirement is vague. Can you name that position?

Btw, anyone figure out how a man with a 19 year old FBI investigation with 600 pages ends up having a son that worked in the Defense Intelligence Agency??? the FBI investigation ended the year kennedy was killed.
One opportunity, back in July. And as he pointed out in court if he dismissed on a technicality then Taitz could refile the next day. It was a better use of the court's time to take her by the hand and show her what she should have done in the first place.
There hasn't been another hearing until today so when was the second opportunity to toss it? Unless you count every time Taitz appears in court a chance to throw her case out?
By all means, keep that sunny, optimistic disposition. Many decades of life have made me somewhat darker in outlook, but I wouldn’t wish my personality on a dog.
