The burden of proof
Times Herald ^ | 8/8/09 | Warren Bonesteel

Posted on 08/08/2009 8:27:14 AM PDT by pissant

For just a moment, let's forget about people like "Dr." Orly Taitz and what may or may not be faked documents. People on both sides of the Obama birth certificate issue have gone completely off the deep end over this topic. Admittedly, for some people on both sides, it was a fairly short trip.

Now, with all of that behind us...

The burden of proof does not rest upon those who doubt the claimant. The burden of proof rests solely upon the claimant. Mr. Obama has said, "I am qualified to be president." For more than a year, more than 40 million American citizens have said, "Prove it." Mr. Obama and his supporters have said in reply, "Prove that I'm not!"

Mr. Obama, et al, have offered a simple and obvious burden of proof fallacy in support of their claims and then followed it up with appeals to ridicule, to popularity, to authority and to false dilemma/false choice -- "Believe me or else you're a nut job!"

In view of the lack of presentation of an original document, there can only be one rational conclusion: An original document does not exist, or if it does actually exist, it contains information that disproves the assertions made by Mr. Obama, the claimant.

Uh dude, did you see posted anywhere that a COLB is acceptable?

I have yet to see it anywhere.

The State Department says the following:
*A certified birth certificate has a registrar's raised, embossed, impressed or multicolored seal, registrar’s signature, and the date the certificate was filed with the registrar's office, which must be within 1 year of your birth. Please note, some short (abstract) versions of birth certificates may not be acceptable for passport purposes.

And yes we want to impeach the information on the COLB like calling the father African, which is not nor has ever been a category or description of race.

Moreover, why didn't Barry present one of the two we know he already has?

the one he found among his mother's belonging
the one he used to obtain his passport and to get into college

Where are they and why go to the trouble of producing another document that is incomplete?

Here is a company that tells you point blank what you need to obtain a Passport:

http://www.visahq.com/birth_certificate.php
The following documents are NOT ACCEPTABLE for passport applications:

Notarized photocopies of Birth Certificates
Hospital birth records or certificates

NOTE: Applicants born in California MUST submit a Long Form Birth Certificate. Short Form or abstract Birth Certificates are NOT ACCEPATBLE.

You can prove your US citizenship with one of the following:
Original Birth Certificate (if born in the United States);
or Old (undamaged) passport;
or Original Certificate of Citizenship or FS-240, DS-1350 ( if born outside the US );
or Original Certificate of Naturalization issued by the Immigration and Naturalization Office.
Note: A certified birth certificate has a registrar's raised, embossed, impressed or multicolored seal, registrar's signature, and the date the certificate was filed with the registrar's office, which must be within 1 year of your birth.

I think a (real) Hawaii Certification-OLB does indeed have a registrar’s signature on the back, so it could be used for a passport...

It’s still the case in most states you’d have to produce a long-form to get a passport though...

Most of this article is well reasoned. But what Bonesteel says in his second sentence - "People on both sides have gone completely off the deep end over this issue" - creates a false equivalence between the "Birthers" and the Obamabots that contradicts the main theme of his essay.

Another crucial point: Obama's day-to-day behavior in office demonstrates the wisdom of the framers to have included the "natural born citizen" requirement for the presidency in the Constitution. A "natural born citizen" president isn't as likely to act in such callous disregard of his country's basic values and principles as Obama is doing. That's enough of reason in and of itself to demand that any usurper who doesn't meet the constitutional qualifications for the presidency, and who achieves the position by fraud, be removed from office immediately.

The Constitution is the supreme law of the land, and, as Theodore Roosevelt famously said, "No man is above the law."

Well, yes, but I dislike having my name mentioned as someone who supported TechDude’s work.

For the record, TechDude, TexasDarlin (TD), and myself had agreed to work together back in the third week of June. After several email exchanges with him, however, I started to have serious doubts about his research. I told TD that I don’t trust him.

(I’ve saved every single email, in case anyone doubts me).

I kept quiet regarding what I knew about TechDude, because of that previous agreement, but also because it would have come out right after Jay McKinnon had announced he lied about forging Obama’s COLB, and knocking him out of the box wouldn’t do me or her any favors.

When she decided to go it alone with him, that ended the agreement and I went off on my own, and this time, i really WAS alone!

Well written. You would almost conclude the author has been reading along on BC threads at FR, seeing all the ridicule and misdirection the obamanoids are spewing.

It is also our responsibility to be able to question leadership. I have been saying all along that the people are being denied due process. Sad that we have to do the work that Congress won’t....

Obama could END this “controversy” with the simplest of acts!:

Show us the BC!

But NOOOooooooo! He won’t do it!

I ask ... “Where’s the BEEF!?!?!?”

And a voice from the back of the room says:

“It’s under the pickle!!”

:)

Face the reality, the democrat party and their affrimative action fraud have set the Constitution aside as a relic of the old Republic they are sweeping away, to establish the federal oligarchy. And they aren’t even trying to hide that fact, naming more than thirty czars now to run the country as their Marxist messiah sees fit and is instructed to do by biggers pulling his strings.

I can imagine that you dislike being mentioned as someone who supported TechDude's research. Probably because you repeatedly publicly supported TechDude and his research, both before and after his July 20 "exclusive":

"TechDude's got the technical details nailed down." - July 15

"Now, this is not to take away any of the work that TechDude has done, which is notable in its own right, and if you read my blog, you will see proper attributions made to him and his work..." - July 23

"I can tell you that I know who is TechDude, and that he is who he says he is, I can also tell you that he is temporarily laying low because of what these nutty Obama supporters will do." - August 12

That last one, incidentally, is you claiming that TechDude was legit and vouching for his credentials just hours before he was exposed as a fraud.
