I agree with you 100%. I’m thinking, what if the corruption becomes so publicly known that voters actually give the House and Senate back to the Republicans in 2010? Then Impeachment is back on the table.

I’m not optimistic. Worse has transpired without much fuss.

I agree that there is a best-case scenario worth hoping for, but also submit that there is a worst-case scenario (the formal approval and legal codification of these activities from another branch of government) to be feared.

Why do I think it’s not wise for a new Solicitor General (who is so inexperienced before the courts that she had to send a subordinate to argue the govt’s last case) to tell SCOTUS what they do and do not have authority to rule on ?

I hope so, too. I wouldn't have thought that Ginsburg would have been the one to do it. But maybe Bambi is getting a tad too arrogant. Dictators frequently overreach.

Justice Ginsberg will poll the court. It takes 4 Justices to hear the case, and 5 to decide in Indiana’s favor. I’m guessing that Thomas, Scalia, Alito & Roberts will cast votes sufficient to grant cert, those same 4 Justices will vote for Indiana and against Benito Obama when they hear the case, and Indiana will win the case or not depending on the state of Justice Kennedy’s delicate emotions the day he has to decide.

USSC would not have issued a stay/hold if they didnt intend to sit and rule on the constitutionality of the whole deal.

I don't think they are going to address the "constitutional" issues. Instead they are going to rule on whether the bankruptcy of Chrysler and the sale to Fiat is legal under the bankruptcy laws of the United States.

If it were a "constitutional" issue, I don't think Ginsberg would have issued a stay, as I'm not really sure she's ever read the thing. But there are a lot of non-constitutional issues that the Supreme Court hears every year and as a general rule nearly all the justices are pretty strict in their interpretation of statutory rules.

On constitutional issues, the Justices tend to be esoteric and often ignore the meanings of the words, but on statutory interpretation, they are all pretty hard lined.

I think this turkey is dead.

GOPers should point to this in their arguments over Sotomayor. The political leanings and social tendencies of a justice are not as important as that justice’s willingness to follow the law. Even when to do so conflicts with their personal politics and social belief.

I really believe these people are so arrogant and drunk with power that they think anyone in their path will just meekly roll over and do their bidding.

This bunch of upstarts from Chicago are finding out it's not that easy to jerk around with the Supreme Court and 200 years of precedent.
