I don’t think this qualifies as an activist court type of decision. It’s merely a strict adherence to the law decision, unless I’ve missed something you’ve noted.

Big maybe. The impression I'm getting from the stories I've read is that the motion for appeal wasn't filed until yesterday, and Ginsburg ordered this temporary stay to allow time to examine it. I would be amazed if the court would up holding up the merger past next week.

I am not sure this would be activism. Is it not a case of the feds taking over a private company? I have never thought this was constitutional. Talk about interfering with interstate commerce!

Why do you say it is “activist” for SCOTUS to take up this case? Do you contend there is not an important constitutional question at issue?
