Meanwhile in DUmmyland they are hearing that John Kerry is actively plotting filibuster. I don't like to link to DU but the thread's in General Discussion, titled "Source tells me Kerry is now openly in favor of a filibuster."

Looks like Bingaman is siding with Harry Reid and Howard Dean too. He's speaking during the democrats' hour, so that means a no vote in all likelyhood.

Based on a blog that was linked on the Alito Hearings thread last night, I pulled out the ones that haven't committed and their status in '06. I was curious as to how many were up for re-election this year, so did a little research and added it (and a few other personal comments). Perhaps with no surprise, many are up for re-election and a few are retiring (and/or have a few other issues (that I'm aware of). (sorry the formatting isn't better). Here's what I think are the remaining open votes as of now. (Current Y-53, N-24 - based on statements, not votes)

Status in '06?
Akaka, Daniel- (D - HI) Up for Election
Bayh, Evan- (D - IN) Running for Pres in 08?
Bingaman, Jeff- (D - NM) Up for Election
Byrd, Robert- (D - WV) Up for Election (& mines)
Cantwell, Maria- (D - WA) Up for Election
Carper, Thomas- (D - DE) Up for Election
Chafee, Lincoln- (R - RI) Up for Election
Collins, Susan- (R - ME) RINO
Conrad, Kent- (D - ND) Up for Election
Dayton, Mark- (D - MN) Retiring
Dorgan, Byron- (D - ND)
Jeffords, James- (I - VT) Retiring
Landrieu, Mary- (D - LA) Issues w & wants $ for Katrina
Lautenberg, Frank- (D - NJ)
Levin, Carl- (D - MI)
Lieberman, Joseph- (D - CT) Up for Election
Lincoln, Blanche- (D - AR)
Menendez, Robert- (D - NJ) Up for Election
Pryor, Mark- (D - AR)
Rockefeller, John- (D - WV) (mines)
Sarbanes, Paul- (D - MD) Retiring

So far Nelson, Johnson, Landrieu, Salazar and Byrd have said they will not support a filibuster....

Senator Salazar heard from some of his constituents.

(whistling, looking innocent)

I read your post and was amazed cause I wrote my Senator (Feinstein) a letter stating I hoped she would put partisan politics aside and vote to confirm this very qualified, excellent judge. Judge Alito!........... She writes me back a form letter yesterday saying she would support my right and womens rights everywhere to have an abortion . And thats why she would be voting no on judge Alito. .........I was so mad! Seems these people are stuck on abortion and are going to support'' my rights'' to have one weather I want one ,or not!

Thanks, Cboldt. C-Span may also be rebroadcasting today's debate later tonight. It would be well worth it to record Senator Coburn's comments; they were superb.

I totally agree w you. I don't know anything about WV politics, but IMHO it's because he's been an incumbent since Moses and he brings home LOTS of PORK!!! I also wonder if he's had any serious challengers in past years (I'm thinking probably not). Looks like he will this year, and, my guess is that if folks in WV watch any debates, they're going to have to take a second look. Also, IIRC WV was a primarily blue state until the last several years. I think that Pres Bush won the state in 2000 and that was the 1st time an R had since Reagan (but could be wrong on that).

In case you didn't see this:

Wealthy Businessman to Challenge Byrd
Associated Press ^ | Jan 25 | LAWRENCE MESSINA,

A multimillionaire businessman entered the GOP race to challenge Sen. Robert C. Byrd on Wednesday, hoping to deny the 88-year-old incumbent Democrat a record ninth term.

John Raese, 55, said he would campaign on a platform touting free enterprise ...

a rebirth of capitalism...

The National Republican Senatorial Committee heralded the filing by Raese, a former state GOP chairman who has sought office before.

Though four other Republicans are running in the party primary, the GOP committee called Raese "the first financially credible opponent Byrd has faced since 1982."

Raese's last major foray into election politics came nearly 18 years ago.

With narrow losses each time, he ran against Sen. Jay Rockefeller, D-W.Va., in 1984 and challenged then Gov.-Arch Moore in the 1988 GOP primary.

If John Kerry is'' actively plotting'' a filibuster like he ''actively plotted'' to win the presidency, we can all rest assured. Alito is in! Lurch is a LOSER!

My granddaughter loves Dora. Two years old. Everything is Dora...Dora this, Dora that.

Take my advice and don't ever let her see Barney. I have two granddaughters and we went thru a serious Barney phase for about two years.

Never thought I would make it till they outgrew Barney.
