John Fund on Harriet Miers: six bombshells await us about her

Here's the money quote:

JF: Here's the problem. Because the White House has been so unfair to Harriet Miers and her supporters, because they haven't collected the information, they've sent you onto the beaches of Normandy without proper ammunition and armament. Because of that, we are going to see six or seven surprises come down the road the next few days, about Harriet Miers. Now all of them are sustainable individually. The problem is because the White House was completely unprepared for this, they're doing a disservice to you and her supporters...

HH: Want to give me an example of one, John?

JF: The Texas Lotter Commission, and all the various contracts that were allocated, how they were allocated, and Harriet Miers' role in them.

HH: And what's that going to tell us about her?

JF: The story will be coming out this week, and it's going to involve possible interference by the governor's office with the operations of the Lotter Commission. I'm not saying Harriet Miers was involved. I'm simply saying these are stories that are going to come out, that need answers, and frankly, the White House hasn't done the homework. I hope they have the answers ready.

Miers has consistently supported Conservatives with her contribution other than those of almost two decades ago and even then Gore was NOT considered to be a liberal but a conservative democrat. Her history is similiar to Reagan in that regard.

LOL, Harriet is no Reagan. Reagan was never afraid to say where he stood on issues. Except for being a good soldier for Bush, Harriet has done zero to indicate she is conservative. Harriet may just be a brown nose who does work for Bush to get ahead. In that regard, she could be a Souter. I really don't think she will be a Souter, but if you want to make a parallel, the Souter analogy is much closer than trying to compare her to Reagan.

Her role in selecting conservative jurists is indicative of that shared belief.

What jurists has she selected?

That White House talking point appears to be a myth.

I think she will ultimately do fine. I just really wanted a fight. I wanted a 40 year old Robert Bork to go up to the hill and do to the dummies what Ollie North did. Just kick their asses and show them for the fools they are.

She has little court experience (no surprise there) and no one has any idea how much motion experience she's had.

Bush should withdraw her, but he won't.

HH: I cannot believe that position, John. John, we've got to have you back, because that is...the idea that there is some level of Con law that you have to get over, beyond being a good lawyer, indeed an excellent lawyer, is simply fallacious. Agree with this absolutely. Constitutional law is a field which any really bright grad student can obtain a high degree of mastery, on a limited range of subjects, in just a semester.

I'm not a partisan of: A) the legal profession; B) Enron; or C) Congress. As a Texan once joked to me, "The only organized crime in Texas happens in the chambers of the Texas State Legislature, and actually [dramatic pause and Texas-style good ol' boy chuckle] it's not fair to call that organized!"

One of the big mistakes a lot of the anti-Miers crowd make is on the qualification issue. Based on her resume alone, Miers is obviously a very smart and an experienced attorney. She has all the intellectual and educational tools to be a fine justice. You don't get where she has gotten without that. In the population as a whole, she is upper 1/100th of 1%.

A second mistake is the assumption that constitutional law is some sanctum sanctorum. It isn't. It's a one year course in first year law school. If you have that and the Federal Courts class, and you work hard in each of them, you understand most of the big picture that goes into being a constitutional scholar.
