Michael Schiavo Files Request With the SCOTUS, USSC Refuses to Take Schiavo Case

Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.

I still think GW could act to enforce the Congressional subpoenas, pursuant to 18 USC 1505--

Shall be fined under this title or imprisoned not more than five years, or both." President Bush is entitled to enforce this felony statute. I think he should, and no sheriffs are going to stand up to US Marshalls. Jeb has a bigger problem, because now he has to violate an order from Greer in order to save Terri. He can do it legally, because Greer's order exceeds his authority, but it makes it problematic.

Laura Ingraham was absolutely livid yesterday, railing on and on about the lousy lawyering Terri's gotten. She made some excellent points, including that Terri shouldn't be made to suffer for her incompetent council, that convicted criminals are afforded even that consideration during due process.

Interesting choice of terms, "pontificating". As in Pontius Pilate, you know. And we all know how famous Pilate became for his decision not to intervene in the planned crucifixion of Jesus. Even Pilate had to wash his hands after his decision.

The whole judiciary seems to be out of control lately .The book "MEN IN BLACK" has hit the nail square on the head. Instead of exerting their activist will to have it their way in this case, they have choosen to be silent to have it their way.Our court system is in big trouble , with new appointments likely soon, a fire storm is a brewing......

Could the local Archbishop of the Catholic Church in her area, make an emergency pastoral ruling and hold that Holy Communion, in this specific case, would be distributed to Terri Schiavo, as blessed by a priest and present in the liquid food that would be delivered by a tube? It does not necessarily have to be bread, in it's physical form.

Accordingly denial of the Holy Eucharist to this young woman via feeding tube, would be an infringement upon her free exercise of religious expression, a violation of her Constitutional rights? Or that feeding tube could be subsituted for oils, for 'Extreme Unction' (Rights of the Dying)?

Brainstorming for ANYTHING here in complete dispair......

I don't remember who it was, but on Fox News yesterday the reporter was saying how it was "actually their FATHER who encouraged them to do this.." Well imagine that! Their father is teaching them morality! In this day and age? WOW (/sarcasm)

You would have rioted when the cops did their jobs? Oh that's right, children can't be violent...

The police do a lot of things to ensure their own safety. It's not personal, it's just how it is. Don't blame the police.

I'm not pointing a finger of blame. However, I'm hearing alot of others pointing the finger of blame at the President and Governor as well as the judiciary. It appears that there are no winners, just losers.

These spineless politicians! Common sense has gone out the window as has the constitution in lieu of the judicial state (remember, judges are just lawyers aren't they so what did we expect?). So many of our founding fathers died for their beliefs and noble causes....yet none of these politicians including the brothers Bush (and I am a Republican) are willing to use their constitutional executive powers to prevent this miscarriage of justice. So much for human rights.

Let's see, the Courts render judgments based on Florida law as written and enacted by the legislature rather than acting on their own and adjudicating the case based on how they feel about the law (which is what most people want them to do) but you call it "Judicial tyranny"?

Judicial tyranny is evident in the refusal of Judge Greer to admit any contrary evidence, be it from nurses who have cared for Terri or from Mayo Clinic experts, that contradict his original PVS finding of fact - which was formed on the basis of a 3-2 split in the doctors' opinions, with the deciding voice being a long-time euthanasia advocate whose videotaped 45 minute examination of Terri contradicts his conclusions.

Judicial tyranny is refusing to revisit the permanent award of custody to a "husband" who has abandoned his marriage, and further only conveniently "remembered" Terri's supposed wishes after securing $1.2M in a malpractice judgement to fund her therapy and treatment.

Judicial tyranny is a federal judge refusing to follow the plain meaning of a statute enacted to found a new review of the facts in the case, including the two noted above. Instead, the judge decided to perform yet another procedural review - as if checking the formula used in a math problem will find the multiplication error that caused the wrong answer to be calculated.
