Michael Schiavo Files Request With the SCOTUS, USSC Refuses to Take Schiavo Case

Michael Schiavo has filed a petition with the Supreme Court asking them to stay out of the case.

Everything you say is true. I knew that the USSC would not get involved in this because of the bigger constitutional questions here unless things were framed perfectly.

The second judge fairly pleaded with the lawyers to frame their arguements to him in a way he could act. They instead argued that her religious rights were violated. When I heard that my heart just sank.

Judges, judges, judges! To hell with them all. Either the President or Governor Bush has to take action to shut down Greer, who thinks he's God, and the rest of these tin-pot dictators involved in this case. SAVE TERRI NOW!

That may be but you're right I don't like this unilateral pre-emptive action on Greer's part. /sarcasm

Some sort of stay on Greer's authority needs to be made, in the name of investigating corruption there, then his injunction preventing Terri's rescue can be temporarily set aside.

Is there no mechanism to stop a runaway court in this land?

I think I would have rioted when I watched the cops putting handcuffs on that little boy and girl yesterday who tried to take in water.

Of course there wasn't but apparently it doesn't matter. Judges can do and employ whatever means they want apparently...

There is no equal but separate between branches anymore. The judge has become the maker, employer, jury and outcome of the law.

This is very sad. but hopefully, this will allow the Republicans in the Senate to do what they need to stop the Usurpation of the law by the judiciary in this country.

They may have done a good job in State Court but in Federal Court they were way over their heads when they went after Greer instead of presenting the new facts to be heard.

Our local radio had that Randall Terry turned down most lawyers that offered their help pro-bono to fight in federal court for what its worth.

I agree.

Where are all the Freepers who are Florida lawyers? I can't believe that there isn't anyone out there who could figure out a way to file something that would block this.

That tells me that there really isn't anything that anyone can do. The law is the law. It needs to be changed so that this doesn't happen again.

So a controlling adulterous spouse (who the wife was planning to divorce before her sudden brain injury) - who along with his attorney (and that attorney's hospice?) have a financial interest in her death, receives the court's backing to euthanize his wife.

Despite a disputed medical diagnosis of PVS and that (tainted) spouse's hearsay (provided only after the wife was awarded a large medical malpractice settlement for rehab therapy) that the wife did not want to live "in that condition".

Where is the political party that loves to jump on
"suspicious timing?" Ah well...

What "condition" did Terry envision at age 26 when she expressed her "last wishes" to her soon-to-be ex spouse? The condition of being able to recognize and smile at her mother?

And the courts have given her helpless body over to Schiavo and Felos despite the loving parents being willing to undertake the cost and care of their daughter.

I think you're right about that. I'm not an expert, so either Gibbs', for some reason, couldn't do it - perhaps time was an issue, perhaps it wouldn't guarantee re-insertion of the tube and a new review would take longer than an acceptable window of time.

Either that, or he's not a very good lawyer. I think everyone's hands were tied with the tube being taken out. That's why, among the most damnable aspects of this case, it is stupefying that the judiciary - heck, at least the legislature - would have at LEAST said, 'put the tube back in so we can have a fresh look at this without a shot-clock to worry about.'

How on earth would an autopsy show whether Terri could, with rehabilitation, experience improvement in her condition??? Autopsies show what is, not what might be.

No. This SCOTUS refusal to hear the case has to do with the steps taken after Congress passed that emergency bill. Apparently SCOTUS doesn't feel that any improper rulings have been made by the lower courts in that matter.

The DCF thing is something else.

Jeb Bush has been at the forefront in this whole matter. the fact that Congress had to wait until the last minute to try this is a MAJOR issue. They could have passed a really good law 6 months ago sparing her life.

Moreover, in 1999, the FL legislature could have passed a bill that DIDN'T call food and hydration "artificial life support" like it did.
