Some say that. Some may imply he would want her to die so he can marry the women he has lived with for 10 or so years. I can't fault a man for seeking female companionship as this man has found under these circumstances, nor am I in a position to call the husband a liar when the court found merit in his remembrance about his claim that his wife's wish to die if she was found in such a state.

Even the "conservative" Justice Antonin Scalia ridicules the Declaration of Independence, noting it has no legal status. And that's where there is reference to so-called "life, liberty and the pursuit of happiness." It's all mere words now. Jefferson has been overruled by Greer and Whittemore.

He's not allowed to do that. The whole point of the law was to make Greer's findings NOT determinative. In assuming that the Schindlers would not prevail in a new federal venue, this judge has implied that he believes no other facts will help Terri. He's advocating for Greer, in effect. This is WRONG. His opinion should be quickly reversed. Of course, I am speaking as a layman, not a lawyer.

Then you ought to go to law school because you nailed it. Of the four prong test for injunctive relief, the judge ruled that the Schindlers met three of the four prongs. The only prong not met and the basis for his reviewing the case was that the Schindlers did not have a substantial chance of winning on the merits.

However, the law passed by Congress states that de novo review of the Schindler's case shall take place in federal court. By refusing to grant the injunctive relief, Whittemore has essentially made sure a de novo review never takes place.

That's why DeLay et al were so sure this legislation would get the tube installed.

It was televised. My take on it was that he meant good luck staying alive....as in Jail House justice may occur before your day in court. I could be wrong, but I really don't think the judge wants the guy to walk.

There were plenty of reports substaniating his affidavit, they have been ignored. Michael kept moving her to different nursing homes whenever progress was seen. The people who condemned her spent 45 minutes examining her, not a whole lot of effort there, and 2 of them disagreed with the conclusion. Accept the truth, Michael Schivo is murdering his wife, and is finally succeeding.

If it's so painless, then why do we see all the appeals to feed the starving people in Third World countries? Would liberals pat a starving, desperate child on the head and tell them their agony is all in their head?

BTW, wouldn't it be nice if Michael suddenly got eaten by an alligater and Terri's guardianship reverted to her parents? They could then immediately remove her by helicopter to a state that would treat her appropiately. Let's remember, babies would die if not fed and hydrated. Why can't someone with some gumption stage a search and rescue mission and get her the heck out of the death chamber? If I were there instead of here, I'd be working on it, I can promise you that.

Well said, volchef...I'm getting a little uneasy with the Florida bashing going on here. We at least speak up and protest about the injustices we see instead of keeping quiet about it, like many other states. We're a large state with a big population. There's a huge cultural war going on here and we fight back instead of just rolling over. Maybe that's why the activism going on at the Hospice has demanded so much national attention. Would that be the case in a blue state? I doubt it!

I do not understand it either. The dumming down of our children in public schools possibly, who knows for sure. I'm 55 and and escaped that, but upbringing,morals,values etc. have changed in this country. We tried to save lives in the USCG when I served. Sometimes losing life in the attempt.

I wish it were that simple, but sincerely doubt it.

I think that those people truly agree with the decision. If they say, "It must be true if the courts say so," it means, "I like the decision that was made."

I've never heard anyone fail to disagree with a judicial ruling they didn't like.

Just look at the Dems hollering "States rights!" (oh, yeah, except when it comes to abortion or any other evil.)

My computer won't bring that up. But I know exactly what you are talking about. This is a failure of law enforcement to do their job and protect someone who is begin killed a little at at time.

This is no different than a crazy man shooting someone in cold blood and getting away with it because no one will put him in jail.
