Manhattan prosecutors declined to pursue an assault charge against Gusmane Coulibaly on Thursday night, instead charging him with misdemeanor obstructing government administration and a harassment violation in connection with the viral Washington Square Park snowball fight.
Coulibaly, 27, was arraigned in Manhattan Criminal Court on Thursday evening and released on supervised release, hours after the NYPD announced his arrest in the case stemming from a massive snowball fight after Monday’s blizzard.
In court, prosecutors said that after reviewing the evidence, they were unable to prove that an officer suffered a physical injury caused directly by Coulibaly’s conduct and therefore did not pursue an assault charge. They said the investigation remains ongoing.
About a dozen uniformed officers sat in the courtroom along with union leadership, including Police Benevolent Association President Patrick Hendry.
Speaking to reporters after the arraignment, Hendry questioned why prosecutors did not pursue an assault charge.
“This was a blatant attack on the uniform that they wear so proudly every day,” he said.

In court, Vomvolakis argued the case amounted to, at most, a summonsable offense and asked the judge to release his client without bail. Coulibaly was ultimately released on supervised release.
Police had initially said Coulibaly was arrested for allegedly assaulting officers who were struck with snow and ice during the gathering. But prosecutors did not include an assault count in the charging documents.
Prosecutors also noted in court that Coulibaly was arrested earlier this month in Bronx County in a separate case and asked the judge to place him on supervised release.
The snowball fight, promoted on social media, drew a large crowd and a heavy police response. Two officers were treated for minor injuries, including a bruised eye and headache, police said earlier this week.

Police officers will likely remember him and fine him maximally in the future.
I guess the point of this is so no normal citizen will want to be a police officer if they’re not backed up by the administration. The positions will be filled with immigrants who have no allegiance to the country and no will to enforcing our existing laws.

At this point all law enforcement in NY city really needs to just walk out and let the city burn. I know that is hard and they need jobs, but this has become more about staying alive.
They are targets with no defense; it is more self-preservation now and that overrides the needs for the job.
Time for Blue Flu.

It was an assault on LEOs.
There are plenty of small towns here in NH that could use GOOD cops.
The pay ain’t as good, I’m sure, but the cost of living is better and it is far safer in Constitutional carry NH where the citizenry supports (mostly) LE.
As I see it, it doesn’t matter. It’s New York.
Anything harmful for the existence of New York is good for America.
The cops should have taken the snowball throwing criminal in and given him the “Abner Louima” treatment for it. He wouldn’t have done that again.

That would be an awesome thing to see happen, I remember some states even put out a release welcoming displaced cops from Blue States, don’t remember the details though.
Growing up in the north, there were a few unwritten, but sacrosanct rules regarding snowball fights. You only threw them at people you knew, typically friends, and normally in the context of a competition not unlike a boxing match or football game. You would never throw snowballs at strangers who had no way of knowing if they were solid ice or had a rock in the middle.
