A federal judge on Nov. 20 ordered the Trump administration to end its deployment of National Guard troops in the nation’s capital.
Trump had said the troops were needed to deal with rampant crime and violence in Washington and support federal immigration law enforcement efforts there.
On Aug. 11, the president signed a presidential memorandum, in which he said the local D.C. government “has lost control of public order and safety in the city.” “It is a point of national disgrace that Washington, D.C., has a violent crime rate that is higher than some of the most dangerous places in the world,” the document states.
Although the federal Posse Comitatus Act restricts the ability of the federal government to use military resources for domestic law enforcement, a president may take over, or federalize, state National Guard troops on an emergency basis in certain circumstances.
However, the D.C. National Guard is in a unique position because the District of Columbia is a federal enclave and not a state. The president is the commander-in-chief of the D.C. National Guard.

Trump does not have to obey this order. The judge has no jurisdiction to make it.The issue does not even rise to the level of separation of powers litigation.

The “DC government” is not the analog of a State, it has no legitimacy as it violates the power delegated to Congress to legislate for the District “in all cases whatsoever”, the President does not even need to discuss the security of the District with this “government”.
Withdraw the troops and watch the bad guys crawl back out of their cesspools and start preying on the citizens again.
As the robberies and murders start again I would like to see the families of the first few murder victims post a multi-million $$ lawsuit against this judge. DC is full of smarmy legal beagles ... some or several of them could take the case.
The US Constitution states that the state laws of Maryland and Virginia apply to DC. Some Fed judges tend to grab power.
Well, anyway, the democrats have decided that we no longer have to obey orders we think are wrong. So, tell the judge to go to hell.
Everyone said “well, DC isn’t a state and the President has control but watch out for court rulings if he tries it in other places.”
What happened to that?
Then Pull the National Guard - give it a month and people will be begging Trump to act.
Yes in the newly expanded judges’ wing. Already crowded in that part of Hell.
