The Department of Justice (DOJ) is asking the Supreme Court to lift a district court injunction that currently blocks the administration from withholding $12 billion in foreign aid funds appropriated by Congress. The move has sparked criticism from foreign-aid organizations and Democratic lawmakers, who argued that it threatens to undermine Congress’s constitutional authority over federal spending. Solicitor General D. John Sauer warned the government could be forced to obligate expiring funds without relief.
Sauer said, “will effectively force the government to rapidly obligate some $12 billion in foreign-aid funds that would expire September 30 and to continue obligating tens of billions of dollars more — overriding the Executive Branch’s foreign-policy judgments regarding whether to pursue rescissions and thwarting interbranch dialogue.”
U.S. District Judge Amir Ali ordered the administration to resume billions in Congress-approved grant payments. The administration appealed the injunction to the U.S. Court of Appeals for the D.C. Circuit and then to the Supreme Court.
A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit vacated the injunction in a 2-1 decision but has not issued a mandate. Judge Karen L. Henderson wrote for the majority that the plaintiffs lacked a proper cause of action.
Plaintiffs argued the executive branch can’t unilaterally withhold appropriated funds. The D.C. Circuit ruled only the Government Accountability Office can sue under the Impoundment Control Act.

Unless the funds were left to the discretion of the previous admin’s discretion to distribute as they saw fit. If they were specifically designated spending, seems to me the proper thing would be for Congress to rescind the spending.

With the regal, low level judges running the country now, why do we need Congre$$ or the $upreme Clown$ of the US?
I would be surprised if there aren’t cases where the incoming administration stopping appropriated funds from congress based on different policies.

Everyone thinks that Biden & crew parked that money in a Private Bank to keep President Trump from taking ‘their’ money away.
Here’s what they didn’t say.
They had no clue that President Trump would be able to go after the money. They didn’t park it in a private bank to lock President Trump out.
They just had developed the habit of parking government funds in private banks because...... it allows for a greater set of options.
The banks love it and keep it on the down low.
The politicians can skim money off the top because the money is under control of the bank and the banks aren’t responsible for approving or accounting for any ‘expenses’ the money undergoes during the distribution phase. The fundees get the money they are expecting and everyone is happy. Especially the politicians. They get to ladle off the cream and ensure No one asks why $12 billion was authorized but only $10 billion reached it’s target.
