The Ninth Circuit Court of Appeals on Wednesday said President Trump’s birthright citizenship executive order is unconstitutional.
In a 2-1 ruling, the appeals court upheld a nationwide injunction against Trump’s order.
The three-judge panel included: Majority: Judge Gould (Clinton), Judge Hawkins (Clinton) – Dissent: Judge Bumatay (Trump).
“The district court correctly concluded that the Executive Order’s proposed interpretation, denying citizenship to many persons born in the United States, is unconstitutional. We fully agree,” the majority wrote.

They left has managed to bastardize the constitution for thier own gain
WE’VE PROVED OTHERWISE.
Those 35 have some conditions attached. We are alone with our unrestricted birthright citizen ship.
“The U.S. is unique among developed nations for its unconditional jus soli under the 14th Amendment”
thank you
The Seattle District Judge ruled that Trump’s actions were ‘blatantly unconstitutional’.
But the SCOTUS has never ruled on birthright citizenship.
Appeals court, Schlemiels court.
There is no benefit in the U.S. from dual-citisenship, plus the other country may still recognize it.
I have dual U.S./British citizenship. I have both passports, still have a health ID number in the U.K. but no other benefits. I also have a Polish passport, just because of my grandfather, and it's an interesting talking point. I then have a Cayman passport thanks to one of my classmates during my Master's program who convinced me and helped the process along. But it was pretty easy since I already had a British passport. But since Brexit, the British passport doesn't do anything for me when traveling in the EU.
Appeals court, Schlemiels court
(But the SCOTUS has never ruled on birthright citizenship.)
Correct! It’s about time they do.
A Court of Appeals is different from a district judge. An appeals court is just one level below the Supreme Court. I don’t think the SC objects to an appeals court issuing an injunction.
There are no guarantees the SC will uphold a ban on birthright citizenship from an executive order. I think it will need at least a law from Congress, so my guess is the SC rejects it.
Yes, that’s how it works, so forum shopping becomes an art of finding some dispossessed person to be a plaintiff within the jurisdiction you want to get into (where you’re most likely to receive a judgement in your favor or that aligns with your intent).
“I know people have gone crazy with believing the “courts” are a Choose Your Own Adventure matter of picking a court”
gone crazy???
Only in your imagination. You do hear a lot about judge shopping, which the democrats do in fact engage in.
That was never the intent and you are being dishonest about that. The originator of the clause stated very plainly his intent, and it is in opposition to what you are stating. You don’t just get to be a citizen automagically because you got birthed here, you have to be born to parents who are not aliens or non-residents for that to confer.
“you have to be born to parents who are not aliens or non-residents for that to confer.”
That should be you have to be born to parents who are not aliens or are naturalized residents for that to confer.
Only one of my four grandparents became citizens.
The Ninth Circuit (California) has the reputation of being overturned more than any other circuit. At one time, I read that two-thirds of the cases appealed from the Ninth got overturned on appeal.
You need to get a 2/3 vote in both houses of Congress to even send it to the states, so you can forget it because the America-hating Dems won’t allow it. Then you need the legislatures of 38 states to approve, and that won’t happen either. Right now only the USSC can end this twisted interpretation of the 14th Amendment.
On the current evidence the changes may not be substantial enough.
People do die...He wasn’t 50 with no medical problems. I think it’s being nasty to his family...but that’s what’s happening...the media messes with you.
Attended a law enforcement conference 40 years ago and the speaker said that this court was known as “The Ninth Circus”.
