The Ninth Circuit Court of Appeals on Wednesday said President Trump’s birthright citizenship executive order is unconstitutional.
In a 2-1 ruling, the appeals court upheld a nationwide injunction against Trump’s order.
The three-judge panel included: Majority: Judge Gould (Clinton), Judge Hawkins (Clinton) – Dissent: Judge Bumatay (Trump).
“The district court correctly concluded that the Executive Order’s proposed interpretation, denying citizenship to many persons born in the United States, is unconstitutional. We fully agree,” the majority wrote.

But executive orders from Obama violating our immigration laws, i.e. DACA, those are good.

They always use the flawed Wong Kim Ark case.
It’s the Nith Circuit Appeals Court ... the most reverted appeals court in the US.

There is a strong originalist argument against the current birthright interpretation. The authors of the amendment clearly had no intention that it could be twisted this way. But yeah. Guess we’ll see.

Wong Kim Ark doesn’t apply, and “decades of Executive Branch practice” doesn’t cut much Constitutional mustard.
How about a Constitutional amendment to end birthright citizenship, by ending dual citizenship, and more clearly define the term “natural born” citizenship? In addition specify that non-citizens do not have an entitlement to the rights of and privileges guaranteed to citizens in the Constitution but are subject to the laws of the United States while in the country.
This issue needs to be finally settled...one way or the other.
I hope it goes the right way, but it needs to be settled.
