The Supreme Court Could Unleash Chaos on the Economy

In less than two weeks, two extraordinary elements of the Donald Trump legal saga will collide — the battle to bring down Trump’s tariffs, and the Trump administration’s fight to prevent judges from blocking his policies across the country.

The Court of International Trade is set to hold oral argument on May 13 in one of the growing number of cases that challenge the bulk of the Trump tariff regime. The lawsuits, which are strong on the merits, argue that the tariffs are not legally authorized under the International Economic Emergency Powers Act, the law that Trump has invoked.

At issue is a motion for a preliminary nationwide injunction to put a stop to the tariffs filed by the Liberty Justice Center, which is representing a New York-based alcohol importer and distributor known as V.O.S. Selections, along with four other small businesses that say the tariffs could decimate their companies.

Just one wrinkle: Two days later, the Supreme Court will consider whether to crack down on judges’ power to check the administration in precisely this way. The justices will hear oral argument in the Trump administration’s request to overturn a series of nationwide injunctions currently halting Trump’s executive order to end birthright citizenship.

Trump and advisers like Stephen Miller have been enraged by the ability of a single lower court judge to issue injunctions that hamstring the president’s agenda across the country. The administration has asked the Supreme Court to “prevent universal injunctions from becoming universally...”

Why is it only Republican nominated Supreme Court justices disappoint?

Yes, occasionally a liberal appointee will go off the reservation and vote consistent with the constitution.

However, it’s the conservative justices that most frequently abandon their principles.

If Roberts is consistent, he'll vote to do exactly what he did with Obamacare and uphold the will of the voters.

Obama campaigned on Obamacare and won. He did what he ran to do and the American people elected him to do exactly this. That Obamacare sucks is not Roberts' problem.

Trump has been talking about tariffs since the 1980s. Tariffs were a cornerstone of his campaign. Trump won the election decisively. Whether one can agree or disagree on tariffs, they didn't come out of nowhere. Trump said, "Elect me and I'll hammer China with tariffs as I've been promising to do" and the American people did exactly this.

And not just tariffs, but shrinking government, deporting illegals, and on and on. These lower courts need to stop roadblocking the will of the American people.

Under the constitution, Congress was granted tariffs control. In 1937, this was unconstitutionally given to the executive branch. I believe SCOTUS will rectify this as it should. If it is retuned to Congress and reset the constitution, a whole hs of laws will be affected along with the alphabet agencies.

Too bad SCOTUS didn't follow the Constitution in that decision. But you are OK with it.

The court will fail everyone....like babies with roe and the ladt one, like slaves with dred scott among others.

Weak leaders collapse at the lnees and roberts is weak and they are all cowards. Except Thomas.

I’m going to guess that scotus will attack Trump by ruling against him in both cases. The deepstate has no other shot.

Congress was given authority for tariffs. Therefore it was lawful for the Congress to delegate that authority to the executive just as it would be to take it back should they choose. Nothing unconstitutional about the president’s instituting tariffs or changing them.

The “shall” means Congress can change international trade terms at any time of its choosing.
