Senior White House officials are reportedly considering issuing retired Gen. Mark Milley a pre-emptive pardon over fears that President-elect Donald Trump’s incoming administration will go after the former chairman of the Joint Chiefs of Staff.
The potential pardon for Milley, who was the nation’s highest-ranking military officer for part of Trump’s first term, was reported by the Washington Post Thursday.
Milley, 66, faced intense scrutiny on Capitol Hill during President Biden’s first year in office after journalist Bob Woodward revealed that the Pentagon official placed secret phone calls to a top Chinese official before the 2020 election and after the Jan. 6. 2021, riot at the US Capitol.
During a September 2021 congressional grilling, Milley admitted to calling Gen. Li Zuocheng of the People’s Liberation Army to tell him that he would personally warn China in the event of a US attack during Trump’s waning days in office.
Milley claimed he placed the phone call because US intelligence showed China was worried about an impending strike and he wanted to allay the US adversary’s fears.
In response to the phone calls, Sen. Marco Rubio, R-Fla. – Trump’s pick to lead the State Department – urged Biden to fire Milley, arguing that he worked to “actively undermine the sitting Commander in Chief.”
Trump later wrote on Truth Social that Milley’s backchannel communications amounted to a “treasonous act … so egregious that, in times gone by, the punishment would have been DEATH!”
The president-elect has also said that Milley never informed him about his calls to China.

Anything is pardonable provided that you are doing it to either undermine, or support the right people.
Milley is guilty of treason.
Milley is guilty of espionage.
Arrest him and indict him.
NO pardon for crimes “yet uncommitted” will hold.
Dunno. But I’d first try Congress rescinding his commission in the USMC. Maybe that would tell him how bad and how treasonous he is.
If he didn’t do anything wrong why would him and Biden be worried? This is as bad as getting caught red handed.
“Secret phone calls” to our enemies are NOT ok? Who knew?

The answer appears to be "yes." He can be impeached retroactively and deprived of the benefits he still derives as a retired civilian official.
Article II, Section 2, Clause 1, often referred to as the Pardon Clause. It states:
"The President... shall have Power to grant Reprieves and Pardons for Offenses against the United States, except in Cases of Impeachment."Article II, Section 4 of the U.S. Constitution specifies who can be impeached and the grounds for impeachment:
"The President, Vice President, and all civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors."Grounds for Impeachment:
Retroactive Impeachment
Retroactive impeachment and conviction can deprive a former federal official of their pension and other benefits. It can also have other consequences, such as disqualification from holding future office and loss of benefits.
None of the above would apply to Milley's military career though because that would fall under the Uniform Code of Military Justice and I think there's a 5 year statute of limitations.
But there is this:
18 U.S.C. § 3281: “An indictment for treason or other capital offense may be found at any time without limitation.”

The better question to ask...if you get a pardon from a guy with dementia...is it even valid? Wills are typically thrown out if the person is noted with dementia.

My understanding the only thing not pardonable is impeachment.
Treason is defined in the Constitution
Section 3.
Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court.
The Congress shall have power to declare the punishment of treason, but no attainder of treason shall work corruption of blood, or forfeiture except during the life of the person attainted.
My blood boiled when I saw this thread this morning. So I jumped out of bed and started digging.
Not being an expert on this stuff, I might have missed some other ways to bring Milley to justice. Hopefully, Freepers more knowledgeable than I am will dig them up.
Right. Overturn 2020 election, reverse pardons and rescind all judicial and board appointments.
