SCOTUS Opinion day [July 1, 2024]

The Supreme Court will be issuing Opinions at 10:00 a.m. this morning for the October 2023 term. You can read the opinions released thus far at Supreme Court opinions.

The attorneys at scotusblog will be liveblogging the release of opinions from the pressroom.

There are four cases remaining undecided for the October 2023 term.

October sitting: All opinions have been released;
November sitting: All opinions have been released;
December sitting: All opinions have been released;
January sitting: All opinions have been released.

February sitting: There are three cases pending.

Corner Post v. Board of Governors of the Federal Reserve System, (an Administrative Procedure Act issue), and the two First Amendment cases. Moody v. NetChoice, LLC, and NetChoice, LLC v. Paxton.

March sitting: All opinions have been released.

And then there is the case we are all waiting for from the...

April setting: There is one case remaining undecided.

Which is the case of Trump v. U.S., No. 23-939 [Arg: 4.25.2024]

Issue(s): Whether and if so to what extent does a former president enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office.

I would disagree with the VP claim in two ways: a) communication has absolute immunity; b) being sworn to uphold and defend the Constitution and the laws also means seeking any remedy to a legal wrong that may be legal to seek.

The VP's powers of "presiding" over the certification of electors is deeply ambiguous.

Trump may have examined whether the states could have sent alternate electors, but at the time of the certification he was only talking to Pence about delaying certification. Hardly a crime, and quite possibly also an official act.

It does. The Court will have what’s called a “clean-up conference” this afternoon I believe. That’s where they dispose of minor lingering matters before the Court. That finalizes this term of Court.

They are pathetically stupid and do not understand separation of powers and checks and balances.

The Supreme Court ruling on case they don’t like is perfect lawful and follows the Constitution.

IMHO, Bannon should have had executive immunity. I believe what happened is at first he refused to testify because he felt he had executive privilege, and once Trump released him from “executive privilege” he agreed to testify, but the committee refused to reschedule his testimony and continued with the prosecution for contempt.

But, SCOTUS refused to take up his case, so off to prison he goes.

“Stop wasting Court’s time...” is not a legal demand.

Their ideology is “the ends justify the means”; nothing will stop them from trying to prevent a Trump Presidency...as we witnessed last time around.

Justice Thomas’ concurrence in Trump v. U.S. is hugely significant. He questions whether Special Counsel Jack Smith’s office is constitutional.

“If there is no law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a former President.”

The remands are to DC courts and involve their analyzing facts and whether these charges involved inner or outer official acts or unofficial acts. That is such a low bar for anti-trump dc courts to overcome.
Justice Thomas’s concurrence seems to invite Trump’s team to appeal to scotus the illegal appointment of a private citizen to a special counsel position. Hopefully, that is immediate or already filed.

As sick and pathetic as that impeachment was, it was, at least, impeachment, rather than sending in the cops and trying to put President Trump in prison.
