Justice Jackson Complains First Amendment Is ‘Hamstringing’ Feds’ Censorship Efforts

Free speech is on trial at the Supreme Court, but Justice Kentanji Brown Jackson is no fan of the First Amendment. The Constitution, you see, limits the government. But leftists want unlimited government — which is why they hate the Constitution.

During Monday’s oral arguments for Murthy v. Missouri, formerly known as Biden v. Missouri, Jackson claimed to oppose any ruling in favor of Americans’ constitutional right to free speech if it limited the government’s ability to censor that speech via Big Tech.

“My biggest concern is that your view has the First Amendment hamstringing the government in significant ways in the most important time periods,” Jackson told Louisiana Solicitor General Benjamin Aguiñaga.

Jackson expressed skepticism at reigning in the federal government’s unconstitutional censorship pressure campaign because “some might say that the government actually has a duty to take steps to protect the citizens of this country” that goes far beyond simply posting its own speech or engaging in constitutional means of securing citizens from violence.

“You seem to be suggesting that that duty cannot manifest itself in the government encouraging or even pressuring platforms to take down harmful information,” Jackson. “So can you help me? Because I’m really worried about that. Because you’ve got the First Amendment operating in an environment of threatening circumstances, from the government’s perspective, and you’re saying that the government can’t interact with the source of those problems.”

Aguiñaga clarified that he wasn’t arguing for a complete ban on all interaction between the government and social media companies, but for that relationship to stay within constitutional bounds.

Justice Jackson:

“I understood our First Amendment jurisprudence to require heightened scrutiny of government restrictions of speech, but not necessarily a total prohibition when you’re talking about a compelling interest of the government to ensure, for example, that the public has accurate information in the context of a once-in-a-lifetime pandemic.”

So it seems as if limiting scientific debate to align with government propaganda is permissible using this logic.

If she were a scientist we would still be living in the stone age.

They use the same logic vis a vis the 2nd amendment to say that most if not all firearms should be banned. So it’s not surprising that they would also try for speech, including “disinformation “ and “hate” speech.

“Hamstringing” is violent rhetoric!
It refers to the action of a competitor cutting the hamstring muscle of other competitors in order to win.

Knife, blood, pain, violence.
The legacy media should get all over this.

She has no business on the court [Full stop there, but I’ll continue anyway]. She obviously doesn’t believe that the 1st amendment is specifically there for the purpose of preventing the Government from being in the business of censoring speech.

They need to present it as government is limiting the free speech of black, females, then she would be on board with stopping it. Identity is everything to these people.

Justice Brown seems to have a deep misunderstanding of what the Bill of Rights is all about. The Bill of Rights was deliberately added to ‘hamstring’ the government. It was the price demanded to ratify the Constitution itself.

I have never found a Democrat to read and study that. Every Democrat I know, sounds like a Republican but RIGIDLY VOTES "against the man."

Unless I’m calling for violence or causing panic leading to *immediate* and *local* risk of death...then f*ck off. I will not give an inch.

It’s limiting the power of government exactly as it is supposed to. Government is not THE source of truth, even during a pandemic...this one was a great example. They didn’t just get things wrong - there was corruption in the institutions, deliberately infringing on freedoms without any ‘truth’ whatsoever.

WTF?! She needs to be impeached immediately.

What part of “ Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”

The ONLY reason the FCC was allowed to regulate speech was because the government controlled and licensed the radio spectrum. There is no law that gives the government the right to demand speech be removed or other speech be promoted. They can buy and place content all they want but under the same rules WE have.
