BREAKING: JUDGE CANNON PAUSES TRUMP CLASSIFIED DOCS CASE
GATEWAYPUNDIT ^ | 10/6/2023 | cristina laila

Posted on 10/06/2023 8:50:40 PM PDT by bitt

Judge Aileen Cannon on Friday paused litigation in Jack Smith’s classified documents case as she decides whether to grant Trump’s motion to extend deadlines related to classified material.

Trump attorneys Chris Kise and Todd Blanche accused Jack Smith’s prosecutors of using dilatory tactics to slow-roll the discovery process and taking too long to turn over evidence. Blanche and Kise said the May trial date makes the schedule “unworkable,” according to the motion reviewed by The Gateway Pundit.

“On July 18, 2023, the Special Counsel’s Office represented to the Court that ‘all’ discovery would be available on ‘day one.’” Trump’s lawyers wrote.

Blanche and Kise also said Jack Smith’s Florida classified docs trial set for May 20 and his separate March 4 DC trial regarding Trump’s so-called effort to stop the transfer of power set for March 4 require “Trump and his lawyers to be in two places at once.”

“The March 4, 2023 trial date in the District of Columbia, and the underlying schedule in that case, currently require President Trump and his lawyers to be in two places at once,” Trump’s lawyers wrote, according to CBS News. “And, months after the Office’s representation to the Court, discovery is not complete in this case—including with respect to the classified documents at issue in more than 25% of the [Espionage Act] counts in the Superseding Indictment.”

Of course, this was Jack Smith’s plan all along. Make it impossible for Trump’s lawyers to navigate between Washington DC and Florida by scheduling court dates on top of each other.

The attorneys said the classification reviews and most basic discovery have not been handed over by DOJ prosecutors.

“These are not mere ‘complaints.’ The Special Counsel’s Office has not provided some of the most basic discovery in the case,” the attorneys wrote. “Given the current schedule, we cannot understate the prejudice to President Trump arising from his lack of access to these critical materials months after they should have been produced.”

"Special counsel Jack Smith's 's office said in a recent filing that some documents are so sensitive that they cannot be stored in a secure facility in Florida with the other documents in the case. Smith's team has told the court that the documents can be made available in a secure facility in Washington, D.C., for review."

I wonder if they agree to go to DC to view the documents would this somehow allow Smith to get the case moved to DC where he can get a rabid Demsoc Judge? Or just get a DC judge to decide what can and can not be accessed? There is some reason he is doing this.

I would think that if Smith filed the case in Florida that is his problem providing access in Florida is his problem. If he refuses to do that, just rule in favor of the defendant with prejudice.

‘all’ discovery that they will release to the defense, that is.

.....so sensitive that they cannot be stored in a secure facility in Florida......

Nonsense. If they were really that sensitive, the "special" counsel would not have access to those documents.

Speaking from personal experience, there are plenty of facilities in the Miami area that can be made a temporary secure facility for any level of classified material on earth.

I assume it is all a scam. They can’t reveal the docs to Trump or his lawyers as it will reveal the fraud they are perpetrating upon the defense and the USA.

The argument that there are documents that can only be viewed in DC doesn’t hold water. There are SCIFs a-plenty on military bases in Florida.

maybe it is deliberately increasing the cost to trump for legal representation since his lawyers would need to charge time and travel for flying to DC and back. Smith should pay for all of that but somehow I fear he will not (voluntarily).

Did I miss the raids on obama and biden?

They have classified docs. obama stores them in a unused furniture store guarded by no one and Biden was not suppose to have any at all in his garage or office at a university that is funded by the communist chinese.

Jack O (Off) Smith is abusing the justice system.

Cannon should dismiss the case outright for misprosecution.

Simple solution: exclude all evidence that has not yet been handed over in discovery.

If Biden loses 2024 - please God make it so - and is out of office, does anyone think for one second Jack Smith is going to indict Biden for all those classified documents in his garage? Not a chance in hell.

This is blatant hardcore election interference by these scumbags and the Republican party says and does nothing about it. Once again Trump is thrown to the wolves by himself just like he had to deal with the coup attempt against him with the Russia collusion hoax, and the two fake impeachments, and then the ridiculous Stalinist Jan. 6th committee.

There is also a special facility in Mar-a-Lago that has 24 hour secret service protection. The only time it was broken into was by government agents who surely didn’t have the security clearance Smith is pretending is needed.
