Dershowitz on Trump Indictment: 'Worst Case of Prosecutorial Abuse I Have Ever Seen'

Harvard Law professor emeritus Alan Dershowitz says the indictment of Donald Trump is the “worst case of prosecutorial abuse I have ever seen.” And he’s not the only one calling out this raw exercise of political power over the rule of law. Thursday night, Trump’s attorney echoed that sentiment, declaring, “today the rule of law in the United States of America died.”

Trump was charged in a sealed indictment handed up on Thursday that is believed to concern a non-disclosure agreement signed by porn actress Stormy Daniels, which the legacy media calls “hush money.” Daniels was paid $130,000 by Trump’s attorney Michael Cohen. Both Cohen and Daniels have declared that Trump didn’t make the payment himself and that there was no personal relationship in 2006 between Trump and the x-rated porn actress. Daniels has since reneged on her statement and, of course, the NDA.

Dershowitz said on the Sean Hannity program on Fox News that Manhattan District Attorney Alvin Bragg is playing with fire.

[W]hen you’re a democratic elected prosecutor who ran on the campaign pledge of getting Trump and you’re going to indict, forget about the former president, the man who may become the future president if he beats the incumbent who is the head of your political party. Posecutor, you’d better have the strongest case imaginable, not a case that depends on stitching together two inapplicable statutes and using Michael Cohen.

Dershowitz has often said that a “first-year law student could win this case.”

The Harvard Law School professor emeritus told The Epoch Times, “In 60 years of practice, this is the worst case of prosecutorial abuse I have ever seen.”

And this prosecutorial abuse is actionable as a federal civil case which Trumo could bring in Florida with The State of New York and Bragg personally ( not as AG) as defendants.

The tort is called “Misprison of Prosecution.”

And an injuction could be issued to stay the indictment and prosecution .

My guess is that Stormy Daniels has been paid a lot of money to tell a bunch of lies under oath. It's not like Democrats haven't pulled this old trick before.

True, but this particular law professor is known to be on the liberal side politically. So nobody can say that he loves Trump or Republicans, as being the basis for his opinion.

The typical retirement job for someone who has taken one for the Democratic team is a university presidency. It’s typically a no-show job with a large payout and whatever visibility the person getting it wants. It often comes with perks like a mansion, a car, free health care, etc.

There is no benefit...
People are going to lose their jobs..
So, why is this being done?
Don’t say because they are stupid, because they are not....
They are conniving, diabolical and evil.
They are not stupid.
So, what is the goal?
What can they possibly hope to achieve?
Or, perhaps, what are they trying to hide?

If we have an answer to these questions, we can plan.....

What you are flailing about for is something called “malicious prosecution” not “misprision of prosecution.” Prosecutors and judges enjoy immunity so this is a non-starter here.

The Younger Abstention doctrine also complicates the rest of your supposed solution.

I just don’t understand why the indictment remains sealed, so people could speak more definitively, rather than always having to qualify their opinions.
