What you are flailing about for is something called “malicious prosecution” not “misprision of prosecution.” Prosecutors and judges enjoy immunity so this is a non-starter here.

I missed a few days here and there in law school due to illness. The day they taught “Misprison of Prosecution” must have been one of them. Malicious Prosecution is certainly a real cause of action, but a plaintiff winning a case like that almost never happens. Can’t get at the DA or judge personally; they have pretty thorough immunity.
