CHESAPEAKE, Va. (WAVY) — An employee who survived the mass shooting at a Walmart in Chesapeake, Virginia, last week has filed a $50 million lawsuit against the company.
The lawsuit, filed by Donya Prioleau, claims she submitted a complaint about the gunman two months prior to the shooting that took the lives of six Walmart employees. Store supervisor Andre Bing, 31, fatally shot six employees and wounded several others before he died of an apparent self-inflicted gunshot, police said.

What of the survivors of those killed?
Indeed she does. Especially ifi there is a long history of coworkers complaining this guy is nuts.
So maybe Wal-mart had given him notice and told him he was sacked and that’s what triggered the gunman…
Did Wallmart open fire and shoot her? Oh, it was a crazed gunman?

“Despite Mr. Bing’s long-standing pattern of disturbing and threatening behavior, Walmart knew or should have known about Mr. Bing’s disturbing and threatening behavior, but failed to terminate Mr. Bing, restrict his access to common areas, conduct a thorough background investigation, or subject him to a mental health examination,” the lawsuit states.
In addition, the complaint alleges that Bing “repeatedly made veiled threats of violence,” stating that people will “remember [his] name” if he was ever fired and ominously asking employees if they had received their active shooter training.”
The first part needs to be proved Walmart didn’t do any of this because it is confidential. Also, is that part of the protocol or just her opinion of what should have happened? And, is the second part in writing?
And what was Walmart supposed to do? Even if they banned him from the store, they can’t enforce it.
This whole episode will prolly cost Wally $1 billion plus.
I hear ya. She has a valid point. WM ignored it due to pc wokery, so her lawyer took the job.
Was she even on-site that day?
The case will be dismissed. She has a workers comp case. She can’t sue in Civil Court.
Probably better WM did nothing. Imagine the carnage if they had fired him because of the complaint.
Negligence may not be covered under workers comp claims.
She won’t get $50 million, but if there is documentation about a complaint and it wasn’t acted upon…WalMart will be settling for a lot of money.
An employer has an obligation to maintain a safe work environment. If the guy was creeping on his staff, the management had an obligation to act. Of course, if this “action” pushed him over the edge…then no liability.
I am willing to bet this is the last “we” will hear about this.
