It’s workers comp. Her Lawsuit will be dismissed. She has a work comp claim for psyche trauma. She doesn’t have the right to sue for the negligence of her employer.
Negligence is irrelevant to a work comp claims. The only issue is damages, and damages are set by statute. If she were a customer rather than an employee, she could sue the pants off Wal Mart, but as an employee, the work comp board has exclusive jurisdiction. She can’t sue in Civil Court.
Not only that but they were probably trying to not do anything to piss off the dude so he wouldn’t file a discrimination suit because he’s black.
I disagree…but we will see.
Walmart will fire an employee caught carrying a weapon, but no one but Bing knew that he was carrying. He was sneaky about surprising the other employees in the break room, or he probably wouldn’t have hit as many.
Yes, on active shooter training, measures have been taken since previous incidents. A store will clear out very quickly when needed. I’m sure that measures will be taken to prevent danger from an insider like Bing, too, and suspect that some menacing psychotic employees here and there are on their way out.
